A couple - who obviously blatantly broke the terms of their lease in regard to

smoking - claim that " smell is not all that bad" and that all they are willing to pay for restoration is for " the one room they usually smoked in."

Does anyone have any idea of how handle this kind of a controversy?

They broke the rules and knew it. They have no say in remediation.

The air circulates and with it so does smoke. It also comes off their clothes when they walk into another room or sit on furniture. Since they said that the "smell is not all that bad" still means they admit that it smells. Your goal is to not have smoke smell at all.

Be firm and don't be bullied. Inform them you want ALL smoke smell out of the entire house. That's why the lease said NO SMOKING. If they didn't want to pay, they should have obeyed the lease rules. --108.69.xxx.xxx

I assumed it was end of lease. If it isn't, then terminate lease. No point fixing it if they still live there. They'll just break it again and you'll fix again. If you leave it alone, it will get worse and they'll know they won.

They may smoke in one room but the odor travels to other rooms. Charge what it costs so the whole property is smoke free. I don't even allow outside smokers because the smoke odor is on their clothes, body and hair and transfers to the property. --99.23.xxx.x

I have to wonder how well does the no smoking on property clause work out. They are probably going to brake that rule for sure. Then you would have to evict them or let it slide. Has anyone trying this had any problems? How did you resolve it? What was the end result. --73.120.xx.xxx

They don't get to tell you what damage they will pay for and what damage they wont pay for.

Some of my tenants and clients tenants are chain smokers. I tell them all that on the day I'm scheduled to work in the unit, they should stop smoking inside and air out the unit. Around 10% of them won't comply. My health is important to me. Having made millions in real estate I don't want to die because of a tenants poor choices. Money with bad lungs is a poor way to die.

When I had to evict a tenant because they wouldn't allow me to work in a smoke free environment, I had to convince a pro-tenant judge that my health is a valid reason why I couldn't effect repairs. Also since the tenant is a chain smoker, they removed the smoke detectors putting all other tenants in my building at risk.

In this case I had to take my full face mask with supplied air and work in the unit like it was a toxic waste dump or a war zone with muster gas.

A long term tenant of 15 years wanted me to upgrade their bathroom and kitchen. After working in their bathroom and being exposed to smoke I refused to upgrade their kitchen, until she could go a few days without stinking up the apartment. She couldn't be bothered to smoke on her patio. When she ate in the kitchen/eating area, a cigarette is part of her meals...between bites. --47.156.xx.xx

I have a tenant who is a heavy smoker, so like Robert, I ask him to smoke outside on days when I’m scheduled to do work. He complies. They also bought a small patio set to sit outside. I’ve noticed, in summer, the house smells better.

Smoke masks the residual moldy/ weed smells from when the house was a grow house (previous owner.) --70.92.xxx.xxx
