She's has become a terrible tenant and wouldn't mind if she was gone,..any defenses if she tries this? --73.249.xxx.xxx

ESA are no longer valid in private housing.

You can tighten up your screening process - that will save you a considerable amount of money in the long run

Get rid of her if she is a problem. I wouldn't say it was about the cat.

Have had one tenant try the ESA line. I told her that she was a little late on that, as Ray explained.

I have an open listed right now. One prospect listed two cats and a dog. She put ESA after the cats. I am not even responding to her. I don't need that drama, especially starting out. --47.227.xx.xxx

If she claims it is a "service animal", call her bluff by asking what specific task it is trained to do.

If you do not know the definition of a service animal and an Emotional Support Animal, learn it now.

If she brings a letter from a health professional: any from online letter-mills are not valid. She must have an ongoing, previous, actual treatment relationship with that person. (check MA laws, of course - they may be more lenient) If you do not know what MA law says, learn it now.

At any rate demand that all required documentation (do not define what is needed) must be submitted within....72 hours, or very fast. And, in the meantime, she has.......72 hours or very fast to remove the animal.

Now, this is assuming your Rental Agreement does not address the proper steps to take if you want to acquire an animal, or the consequences if those steps are not followed. If it does, do what it says. (If it doesn't, fix it) This is also assuming that animals are allowed, if properly applied & screened.

If all animals are prohibited from living in the property, your Rental Agreement should have an explanation of the consequences.

You can tell her that if the cat doesn't find a new home (fast-give a deadline) then she will be, asap. How important is that animal compared to stable housing? --72.218.xx.xxx

In reference to Ray & Zero: keep in mind that is at the federal level. Your state or locality may still have some different rules. Particularly in a state like MA that seems to be more anti-landlord than some others.

So know MA is tenant friendly like CA. We still have ESA rules that are too flexible and I cannot non renew. Pretty much any health professional can write a letter. Luckily this has only ever come up a few times and I only have one ESA animal in a MF. The little dog is generally quiet and even without the doctor’s letter I would have believed the necessity. --162.204.xxx.xxx

DJ,. I think for cats, snakes, birds etc, they say that it's for "emotional" support.

I was wondering if there was any rules that you could require contact that Dentist, Podiatrist, Proctologist or whatever asking for a letter explaining how they arrived that evaluation. Maybe in they have to do that,..they might not be so quick in just writing a note that their patient "needed"it.

I add some rules to the letters although some could be overruled if actually challenged in court. I require it to be a professional they have actually visited. and preferably they have an ongoing relationship. The rules allow an online professional. I also require the evaluation be “recent”. Third I require that I be able to personally verify the letter by speaking with the person who wrote the letter. To me these all seem reasonable to filter out the liars and for me it has worked. It’s only the first criteria that’s in disagreement with the rules. --162.204.xxx.xxx
