I've been NO SMOKING., however i have a otherwise qualified application who is adamant that her boyfried only smoking occasionally and outside in his car or at work, So I'm looking to motdifiy my lease clause, Please share your lease cluase on no smoking or smoking in a non smoking property. (oh and i'm no pets, but they have a cat ... can you guess this property has been vacant since March and while activity is high, the applications are poor) I have addressed the pet (cat) with her and the cost and she's ok with all that. Please share your any clauses to help protect with lease/paperwork/agreement on SMOKING.

Do a very thorough in-home visit. Cats and smoking have been an odor problem in my last 2 purchases. In my rental, I haven't had too much trouble with cats, but the last one left an odor.

Smoking by Residents or visitors leaves a nicotine residue and odor which increases the costs of cleaning, interior painting, and odor removal. In multi-family dwellings outdoor smoking must be 10 feet away from any doors or windows so smoke does not drift into other homes, apartments, or common areas and act accordingly to prevent disturbing other people. Cigarettes, vapor pens, e-cigarettes, pipes, cigars, hookahs, marijuana, hashish. cannabis, hemp, and any other smoking device or material fall under the lease’s smoking policy. In my experience smoking "outdoors only" ALWAYS leads to smoking indoors. Even if one were to only smoke outdoors, the smell still gets in the house. AND cigs are EXPENSIVE. Guess what comes first if it is rent vs cigs? --64.246.xxx.xx

Former smoker here (quite 38 years ago.) I smoked outside only because my DH hates smoke bad enough that I was indeed properly chastened. But it stayed on my hair, clothes, etc. I smelled and so did the air around me in the house.

We have "outside only" smoker tenants who sit on their deck as asked back in the day, but the smoke wafts into the neighbor's open windows in the spring and THEIR house smells worse than the smoker's sometimes.

So now we are absolutely positively No Smoking ON PROPERTY landlords. If hotels and apartments can do it, so can we.

Besides, smoking is SUPER expensive these days. --73.216.xxx.xxx

We make the insurance company the bad guys. No smoking anywhere on the property per our insurance company.

That's why on the prequal it asks: On smoking do you

1. smoke indoors and outdoors

2. smoke outdoors only

3. don't smoke

I agree about policing the paperwork. A person should be able to come up with a good lease agreement that the common person can understand, and all can follow. But there always seems to be some changes that have to be made because changes in humans. Animals remain the same. I should just open up an animal hotel, but alas, I would have to collect payment from some human. --73.19.xxx.xx

my mkt is no smokers. clause 3 is no smoking in the house. I know they have friends over who smoke. They can smoke outside. Smoking inside is an automatic violation of the lease. I have not (yet) had a violation in 30 years. The other renters in the houses are my prefects. --146.75.xxx.x

If you want to work w them, establish a designated smoking area on the property. Personally I wouldn't go on the gf being able to dictate what the bf does. There are the rare few who do not smoke inside. What does the current and former ll say? March is a long time, but I've held out longer. You might consider a lease period that carries you to April next year to get through the winter. --24.29.xx.xx
