I am buying a house from a man who owned a house with his wife when she passed in 2023, she had 2 judgments filed against her in 2018 and 2019.Ttle company is saying they are no longer attached to the house after her death,I disagree. Anyone else with knowledge have an opinion? In NY judgments attach for 10 years so we are still in that time frame --98.98.xx.xxx |

6x6- 1 is discover bank and the other is synchrony bank,i assume credit cards,i see this all the time ,very rarely does anyone or banks etc actually go after a judgment more than attempting to garnish wages, most people have no idea how and it is too costly, bank isnt going to hire an attorney to foreclose on a house for a $5000 judgment so the judgment just sits there and if they sell the house usually the bank gets paid.I am only paying $15000 for this house,leaving judgments there and in a few years they drop off after being attached for 10 years.I can wait out the time and fix it and collect rent in the meantime. Why would the title company say that? in theory they should know more than i do so maybe they are right and then there is always the chance they are wrong.the guy who used to do that job at the title company recently retired and there is someone new making those decsions and i have no idea about that person --98.98.xx.xxx |

I understand what you are saying Ken but if the title company is saying it's cleared - it's on them isn't it? That's what they do... check the title and point things out and if it's clean then they'll provide insurance for it - if something happens and they didn't catch it they cover it.

jonny,my issue is this. if i buy insurance it is only on $15000, if i sell it in a month for $60000 i am not sure they would have to cover the whole thing since i only have $15000 of insurance.i dont mind leaving the judgments in place but i expect the title company to be accurate. this is not my usual attorney and not my usual title company, i am trying out a new attorney because i like having a couple attorneys in case something happens and the last occasional attorney just died and my regular attorney is over 65 and will retire before i do so trying out a young attorney who seems to be sharp, i should have asked them to order title from the tried and true title company in the area --98.98.xx.xxx |

Ken you are correct about the limit of coverage is based on YOUR purchase price. The question becomes - How large are these judgements as compared to your purchase price.
The deed being "tenants by the entirety" provided the extra level of protection in this that is beyond "joint tenants" status. Jerry, no they banks, unpaid credit cards.Ray, the debt may have died with the spouse but i believe the judgment remains against the property,that doesnt automatically go away does it?purchase price is $15000 and another $8000 of judgments --98.98.xx.xxx |

I can't tell you what estate law looks like in NY. There is a limited time for creditors to charge a judgement against an estate in Pa - one year.
