I put my 2 SFH homes in Turobtenant about a year ago. I made both leases in Turbotenant using the Texas lease.

Its completely on me but I want to make a note that that Texas Lease does not enforce eviction on non-payment on the 1st or any other date. I believe in Texas I can only sue for rent, not late fee, and it she walks into court with rent 27 days late she can stay. And I cannot evict which I would like to do. Hopefully the court will charge the court fees I paid to tenant. And I will be changing future leases.

In Texas, you can include late fees in you eviction provided they are stated in your lease, they are not charged before rent is 2 days late, and they are "reasonable."

You can also refuse rent once an eviction has been filed. --50.230.xxx.xxx

Right. you are not required to accept payment once an eviction is filed according to Texas law. The judge may ask you to consider it if the tenant shows up with the rent, but you can refuse it. That may negate your suit for the back rent- not sure- but you will get rid of your bad tenant. --50.230.xxx.xxx

I don't believe there is language in my Turbotenant provided lease to refuse payment. This is what ClaudAI said

Bottom line for your current situation: You can charge the late fees as written, and you can issue a 3-day Notice to Vacate for nonpayment under Texas law. But outright refusing to accept late payment (rent + accrued fees) before filing eviction is risky without explicit lease language supporting it — a Tarrant County JP might not look favorably on that. Again, I'm not a lawyer, and I'd recommend consulting one before taking eviction steps.

What I will do is turn off ability to pay rent on Turbotenant and send her letter saying only cashier's check or money order with court fees and late fees and nsf fees. --172.56.x.xxx

Went to court, tenant came to give their excuse. I got default judgement, but tenant has until June 2 to appeal, then I can schedule constable.

I put in lease tenant is responsible for drains, I am responsible for supply lines. Gave some line to judge about plumbing problem, judge just asked if she had put it in writing to me, and she of course hadn'lt. --172.56.xx.xx
