Happy Springtime everyone.

I found a very good deal on a 3/1 rehab on the same street with two more rentals I already own. We were doing the title search and the widow lady who owns the property found out a mortgage from a private individual was still on the property.

When i asked if the mortgage had been paid off she said yes. Turns our her husband had borrowed the money but he never got a 'full satistaction of Lein". after paying off the mortgage.

The husband has passed away and so has the individual who loaned the money. However the individual who loaned the money his wife is still living. How can i get clean title? Anybody ever had a situaion like this?

How long ago have they let the lien stay on their property? Months, years, or decades?

In my state, the lienholder needs to release the lien within (30?) days of the final payment, or else they open themselves up to massive penalties. Texas does not like this kind of thing, because it's been associated with predators.

In your case, it sounds more like an inexperienced lender and an inexperienced buyer. Because of that, you'd probably want to get an attorney on board to guide you through the process. He'll probably start off by writing a demand letter to release the lien with the County Clerk/Appraisal District, and if that doesn't work, to file a suit for Quiet Title.

speak to your attorney, this is pretty commom with seller financed deals.they get paid off but noone knows to do a satisfaction. the widow can probably sign a satisfaction but again your attorney or the person writing the title policy can give you the answer for this particular situation --38.248.xx.xxx
