State Specific Question About: PENNSYLVANIA (PA)
Originally there was a lease and security deposit between the owner and the tenant. The owner turned the property over a property manager. The property manager started a new lease with the same tenant. Now the tenant is moving out.
Should the move out condition of the property be compared to the original lease time of the owner and tenant or compared to the new lease time between the property manager and tenant? --174.59.xxx.xxx |

That makes common sense to have the 1st moved in condition be the baseline. But is contract law different?
That original lease was terminated. Now it's a new lease in place with the PM on the new lease and no mention of the owner.
If I was a tenant, why couldn't I think that only the current lease with the PM is valid and the old lease is meaningless? --174.59.xxx.xxx |

True, tho usually lots of opinions which often seem to drift towards clarity.
I'll report back on the result after it's sorted. Me pating a lawyer wouldn't be cost effective.

Any time there is a new lease it is considered an update, in my opinion.
If there were problems that were not caught by the PM service there should be questions about that.
When I give a tenant a new lease I do not disclose anything that is amiss that wasn't when we did the prior lease.
Say there is a stain on the carpet now, but the carpet was new when the tenant moved in. I am not going to release them from the liability of the stained carpet, even if they say they can live with it for now.
If the PM is trying to collect for damages that were there before the original lease was signed then they are at fault.

The problem is what baseline condition to use for move out condition. Tenant has only been there 3 years, but says the broken window and broken stair spindles was before current lease. We plan on charging the tenants to repair that items as common sense. --174.59.xxx.xxx |

Ha, funny that the tenant thinks he is now not responsible for damages because of a new lease.
