New York appeals court strikes down requirement that LLs accept Section 8 vouchers as it violates the 4th Amendment. S8 requires warrantless inspections which violates LL property rights. Article states this decision may impact other states that require LLs to accept S8 vouchers... --98.97.xxx.xxx |

Is that AFTER Tish James appealed? We were told it is still up in the air and don't dare to say "we don't accept s8"... yet. --64.246.xxx.xx |

That would be great news.
Maybe a step in the right direction at least.
Would be wonderful to stop some of the entitlement that seems to go hand in hand with the S8 people I have dealt with in the past. --47.227.xx.xxx |

MMIT- I think it would make rental certificate type inspections illegal --98.98.xx.xx |

MMIT, the "illegal search and seizure" part is that in the S8 contract, you have to agree to giving up all of your financial records, computer hard drives, etc. subjecting yourself to a financial colonoscopy by the Housing Authority and HUD. Not so much the actual physical inspection. --64.246.xxx.xx |

Truth be told, they'll probably re-word the S8 contract so that it takes some of the "seize your records" part out thus rendering it less egregious to the constitution. --64.246.xxx.xx |

gEEZ ... WOULDN'T that also apply to occupancy permits.
I my hood the govmnt overlords would ask the peeps "how long have lived here" to determine if a permit was issued on tenancy. Then FINE accordingly. --198.168.xx.xxx |
