So far, a Texas judge is holding back the tide, but basically if you do a cash deal without bank financing including seller financing for residential real estate, you are subject to a colonoscopy. To date, commercial RE is exempt, however "mixed use" is not.

Also the purchase contract is being revised so that a cash buyer who "takes advantage" of someone in foreclosure can be sued.

In NY if you take advantage of someone in foreclosure you can be sued under other laws.Every time i buy a house in foreclosure i am basically taking advantage according to the law but by the time i get to closing the people selling me those houses have become my friend and are just happy i got them out from under the problem.I bought one a couple years ago and the guy told me i was a godsend,my attorney and my wife are still laughing --98.98.xx.xx |

NE-I have learned that for a short time after a new law everyone is trying to comply and uptight about it,as time goes on no even including attorneys,title etc even tries to comply any longer,everyone knows it is still there but noone bothers anymore --98.98.xx.xx |

But until they do it stinks for the ones that prefer to pay in cash.
Although I am reconsidering this on hold units as cash out refinancing ends up costing a little more. But the banks around here make it such a pain to buy a non-owner occupied place. It's as if they never work with investors. --47.227.xx.xxx |
