I'm so sorry. I almost had it happen. The parents of the young man moved him back into their home and he overdosed a few months later. I have what's expected as a clause in my lease. Without such directives prearranged it could be difficult. Maybe this will give you some direction.

DEATH DURING LEASE

a) If Tenant dies during the term of this lease and is a single person Tenant:

1) Tenant’s heirs or the executor of the estate have the right to end this lease two (2) months after the death of the Tenant.

2) The leased property must be free of all furniture, cleaned and ready for move-in by a new Tenant before written notice of cancellation is given.

b) Security Deposit is returned when:

1) rent and other charges remaining due are paid in full;

2) all furniture and personal belongings are removed and leased property is clean;

3) a replacement Tenant is found who will take occupancy at the end of the two months.

c) If lease is signed by more than one person, the surviving Tenant(s) who signed the lease are responsible to complete the lease. --208.67.xxx.xx

It seems like the remaining tenant should be held to the lease. uhh but you've already let them out. I would hold them to the lease UNTIL move out is complete and then follow your states rules to return the remainder of the deposit. my 2 cents --208.67.xxx.xx

Check your local laws. In the "wonderful" state of NY, the lease does not pass on to the estate as of Hochul's 2023 edict. The heirs can terminate the lease immediately upon return of keys and broom clean condition. --72.0.xxx.xx

Lease only has 1 more month remaining plus the time of year will help me attract a good tenant hopefully. I also haven't said or done anything to release yet. Plus I will be raising rent to market rent. During the residency I raise rent but not to market and last few years it's jumped substantially.

Is there any insurance companies that cover bio hazard clean up and remediation. From what I am reading on my policy it seems vague and unclear. Know that I should have reviewed better but this is a unique and different situation that I never planned for. --172.58.xxx.xx

The tenant is still alive. Her son who wasn't on lease is the one who is deceased. I'm trying to be as compassionate as possible for the tenant. Would sending suicide support groups for parents be ok or tacky? --172.58.xxx.xx

Tony, dont get involved trying to help, that is the families job. Mapleleaf,mosst tenants never have an estate upon there death and you cant hold anyone to a lease they didnt sign so Hochul was just looking for political points and her consituetents were too dumb to realize it didnt accomplish anything as usual --98.98.xx.xx

You're right Ken, it's just a long term tenant who has been very good at not only paying on time but keeping unit in good condition. I'm a licensed Realtor so that is why I am going to assist with finding her a place (I will be paid a commission). Just hate seeing her so distraught. --172.58.xxx.xxx

I've had two deaths I think. I don't know if you'd call them suicides.

One was an OD, but she didn't mean to do it as she called for help but not in time. BF moved out, his friends moved all his things and cleaned the place before we even KNEW. Sad, but we just re-listed and moved on.

The other was kind of an OD. Mom took too much, went to hospital, was given whatever, and sent home pretty much immediately. Then died at home from whatever she was given rather than the OD (which is a side-effect of the meds that save your life, they can also kill you if you are not monitored for awhile.)

That was interesting because I told her family they could take their time moving out, we would hold off re-listing until they gave us the go-ahead. We asked them to be sure to leave it clean according to lease (yes, I did.) Then I withheld that month's rent from SD refund. Lawyer called and asked if we could be nice enough to return the money to the kids anyway...I said we had given her a break on the move-IN and this was just a few months later...when he heard about the move-in break he gave up. I'm sure we are listed as greedy LLs because of that, though. --73.216.xxx.xxx

Had a peep in a three family in the hood hang himself in the basement. Within a month the whole building vacated .... said the place was "haunted". Might be unique to the hispanic community.

People have short memories. Place was rebooked in a couple month.

A colleague had a tenant OD. It was four days before they realized it; "yeah, I smelled something bad but didn't know what it was."

Insurance covered the cost. Had to replace flooring and repaint. Call your insurance agent and ask about the specifics of your policy. Yes, there are companies that specialize in this kind of remediation. Ask Google or ChatGPT for a local recommendation. --65.25.xxx.xx

So I contacted insurance and agent didn't think that this will be covered by my insurance. I had a bio hazard company come out and remove the carpet and clean up the blood on the ceiling and walls. Guy told me that if insurance doesn't cover it then they will write it off as they don't charge the landlord, tenant or anyone in cases of suicide. --172.59.xxx.xxx

Tony,

Tough one.

Stay out of grief counselling -be the property manager.

My method is "business like compassion". Think like a Funeral Director - "Sorry for your loss, let's get you moved."

You can HONOR the family by keeping it moving. Yes this is a terrible tragedy but YOU have a business to protect.

The problem is everyone will want you to wait and wait, and drag their feet, "give them time" while you lose money, so I want to calmly and professionally keep things moving.

My guess is the family is not staying in the home and friends will help them pack up/move.

This may not be official protocol but WE cleaned up the mess. Rubber gloves, goggles, black garbage bags, close the blinds so gawkers cannot see. Hauled it out after dark to avoid attention.

I had to block the door to keep the daughter out. She was in tears and wanted to see where her Mom was murdered. I had to be firm. She probably thought I was mean, but the scene was awful.

We gathered up all personal items and clothing from the room for the family.

We cut the carpet and mattress cover into strips, stuffed into 55 gallon size garbage bags.

Wash the walls, prime with Zinsser BIN, wait 24 hours to cure, paint.

The whole process only took a few hours with help. I gave each helper $100.

Yes, I the cleaning and replacement costs from the deposit. THAT is why we take desposits.

It has been a while since I have had one of these. I had a young resident that ran into trouble with the law at work. She was caught stilling brass scrap in bulk. The day she was supposed to see the judge, she checked out.
