NY AG is appealing the recent ruling against mandatory S8 acceptance. Go figure. Our recent local landlord meeting had a property manager speaker who thought she would NOT appeal the ruling.

They still can't MAKE you accept it. You just can't say NO because they have legitimate funds (it's considered discrimination of lawful source of income).
If S8 (or whatever agency) is paying the portion you can still deny if they don't have your minimum of (whatever it is --- 3c, 4x, etc) of LAWFUL income to cover what the agency isn't - then you can say NO. If the agency is paying the entire thing then you still can do a background - you just can't deny on the INCOME part.
The paperwork the agency is "making" you sign is just stating you will (usually) keep it in habitable condition. The tenant has to as well though... yours still is in place (the lease) ... they can't make you do something you aren't agreeing to.
If they want you to have an exhaust in the bathroom but you have a window... they can't MAKE you install an exhaust. If they won't accept it... then fine. Move on to the next candidate. --47.231.xx.xxx |

I haven’t tried to fight this but my take. We are required to take S8 here. This rarely is an issue though because most of the applicants fail on so many levels. But I do know they want specific language added to the lease. Without that language they won’t accept the lease. So I can accept S8 but not their contractual language. I hate hearing that it is free money coming in. No it isn't. I am paying myself since it is funded by taxes.

I don't know the NY law but if my house does not pass inspection because of a cracked switch cover or missing door bumper, it's not on Sec8.
