STATE SPECIFIC NY
A rent payment can only be considered late if it is received more than five days after it is due.
The most your landlord can charge as a late fee is $50 or 5% of your monthly rent, whichever is less.
Before signing a lease, the most a landlord can charge is $20 for a credit and background check.
The landlord has to give you a copy of the background/credit check, as well as an invoice from the company that performed it. Otherwise, they can’t charge you for it.
You can provide your own background and credit check to avoid any fees, as long as the background/credit check was done in the past 30 days.
Your landlord must send you written notice by certified mail every time you are more than five days late with your rent. If your landlord fails to provide you with the notice, you can raise this as a defense in court.

Map, I just looked at a house today that you could pick up for a nice price. Friend of the family so I won't touch it.
Time to start working on the relocation.
My lease states late after 1 day. 10% late fees, which is ridiculously low to me.

Here, we’re capped to a 10% late fee, $50 application fee, and we also can’t charge a late fee until a five day grace period has expired. We used to be pro-landlord here…now, not so much. Our five day pay or quit is soon to be converted to a 14 day. --143.105.x.xxx |

Double-check on the status of the lease: some states allow the lease to be the notice, if it includes a "Waiver of Notice" of future notice regarding late rent. In other words, the lease is the only reminder of late rent required.
This is not in the Landlord/Tenant laws but standard contract law, as I remember from somewhere.
You still have to wait to file for an eviction whatever your state requires (NC it is 10 days) but the written lease serves as the notice. --173.18.xx.xxx |
