OK I 'm going to sell a 4 plex with 2 problem tenants,..one is a sect 8 this is Ma and I have spent tens of thousands on getting one of them out,.since 2022 and she is still there, and owing 30 k in back rent,..the judge says (finally) that she owes it and must pay it as well as making reg monthly rent ,..so she is paying an additional 100 a month to pay that part back as she has told the judge that's all she can pay with (now) paying the monthly rent,..and apparently he has allowed it but must submit any tax return.She still causes problems like moving a boyfriend in (or rental contract says no new people i w/o permission and there would be an increase of rent if approved) Installed a washer dryer w/o permission added cheap cupboards and painted again against our contract etc,..
I'm hating to try to sell this place with these problem people there,. so my question is does it make it any easier to make them move if I'm selling the building?

She is paying $100/mo toward 30k? That will in no way even cover the interest, if you are allowed to charge interest in MA.

Zero, actually I think its about 35K
The judge strongly said you are required to pay this debt!,..I was hoping that she can find a smaller/ cheaper place to have more money to pay it off I belive the lawyer said that we might be able to attach her tax refund but I doubt that would be very big,..and next year she could manipulate that,. but as far as owing money,..isn't that what banks are for?,..to lend money? Why should I be a lender of money to a court ordered debt payoff?
30 K is not small amount and that I would like to have and I understand is less that her SUV cost,..maybe sell it and can get a cheaper used car? lots of them around FOR 5 or 6 k around here, they run well and warrenteed for a while,..Her husband was there for much of that time when the debt occured,..wouldn't he bear some responsibility to that debt?

I am not in MA and only know about the rules from what is posted here.
That being said, you mention that she owes you 35k. You have been trying to get rid of her for a long time and it only costs you more.
At some time you need to decide enough is enough. You seem to be bleeding money on this apartment. You have already lost the 35k. We all know that $100 a month will take 350 months or 29.2 years to collect. She is NOT going to pay you more than the court demanded, if she even pays that.
So why not use the lost funds as a bargaining tool? Chances are you will never see that money. Maybe a small portion if you are lucky. She could file BK on the judgement and then you get nothing anyhow.
Maybe use the settlement as a bargaining chip? I know I would be pissed if someone owed me that much, but you are in a state that allows deadbeats to get that far behind. You are wanting to sell the property and she is in the way. How can you get rid of the constant problem? Not by asking her to leave. Not by having the courts try and force her out. In my unprofessional opinion you have one legal way to try, and that is bribe her with what she owes you.
Crunch the numbers. You want to sell. Will not collecting a part, or even all, or the 35k hinder your sale? You lost it already. It's now a tax write off. Makes you angry I know, but how will you move toward your new goal?
Even if you decide to keep the property, maybe work out a deal and get her out so you can start fresh. Sounds like the place is nice and should rent fast. You have years of experience on who not to put in there.

She is not selling her car or getting a cheaper place,she has a place that is cheap and she is in charge of with the blessing of the judge.I would hire one of those professional squatters to move in and get rid of her for good or i would drive into the building and get it condemned or something to be rid of her. --98.98.xx.xxx |
