If my tenant doesn't move out this weekend, I probably need to give the non-renewal notice, but someone brought out the good point that it will give the possibility of ammunition for the tenant to tell the judge I gave her until the end of the month (April) even though I tried to explain to her back in December that is not the case for non-payment.
I thought maybe it is best to word it as month to month lease is not being renewed. Since payment has not been made it would be in her interest to vacate asap. Most of the time, it is best not to state a reason for the termination. DH said not to even wish best of luck in housing search.
I gave the 72 hour notice for an inspection Monday at 830, she never replied. We want an idea about what to put for damages before warrant Tuesday. --216.126.xx.xx |

Hopefully, you have been documenting the communication you have been exchanging over time, and that will show the judge how you have been trying to "work with them".
Now, I'm a bit confused with your timeline.
A MTM agreement requires 1 rental period notice, by law - unless your agreement says more is required.
If you expect them to bee out this weekend, then you must have given them written notice of non-renewal on or before February 28th. If this has been all verbal "explaining", then that would to hold up & you need to give the written notice of non-renewal NOW - no later than Tuesday - so they will need to vacate at the end of April. (assuming rent is due on the 1st)
If you did, indeed give that written notice before March 1st, and they do not vacate, then they are in a "holdover" situation where they will owe 150% of the normal rate until they leave. Do they know that? This "holdover status exists until they leave, whether voluntarily or with the Sherriff's help.
Of course, you will file an unlawful detainer on Wednesday if they are still there - do not waste any more time.

Clarification: That should have said "will NOT hold up"

Sorry about that, I had posted a few days ago with more details. We posted a five day pay or quit on 03/25/26 for remaining rent due for March (200.00). It has not been paid.
So I intend to go get the warrant on 03/31/26 but believe I should give a month-to-month lease non-renewal statement as well, just in case she pays. We want her to leave.
We need to renovate, there has been some damage, and go up on the rent since she has been there 12 years and is not paying on time now or taking care of it. --216.126.xx.xx |
