STATE SPECIFIC-NYS

Statewide Senate bill S9090, A04093, S1403 Winter Eviction Moratorium resurrected and probably will be pushed through via April's budget.

Key takeaways:

1. No evictions between November 1st 12:00 a.m. and April 15th midnight

2. Landlord must uphold all the clauses of the lease and observe all tenant rights by maintaining the building, not retaliating against the tenant Etc

3. Fines up to $50,000 per incident if found in violation

4. Does not apply to hotels nor rooming houses

If this goes through it will bankrupt small mom and pop landlords, make it harder for tenants to find housing, and completely swamp the courts. Bad actor renters could conceivably move in just before November 1st and stop paying for at least 5 months.

To add insult to injury Assembly Bill A9033

"Extreme Weather Tenant Protection Act"

"Any period for which the national weather service has issued

9 an official warning or advisory for excessive heat, defined as a fore-

10 casted heat index or real-feel temperature of ninety degrees Fahrenheit

11 or higher; or

12 (ii) any period for which the governor has declared a state of emer-

13 gency under section twenty-eight of the executive law related to extreme

14 cold, storm, flood, wildfire smoke, or other severe weather event; and

15 (b) the seventy-two hour period following a period under paragraph (a) of this subdivision

Time to sell and move to a state with property rights. This will only make rent double due to the higher risk. Also screening will go through the roof if you know you can't get bad apples out. What's going to happen is no one will let it slide (meaning if they are late... no "ok, yeah pay me in a week" it will be an immediate 14 day notice) because otherwise, you most likely will or could run into "sorry - new law".

You know this is all coming to a head and it's because it's an election year for snagglepuss. I just don't understand why the politicians think "lets protect the people that don't pay". they are NOT the ones paying the taxes!!

s/The problem is that that not based upon that tenants are able to pay rent but refuse to. During the pandemic here many tenants had adequate income to pay rent where the government allowed rent free. In the province of Ontario many evictions occur during January on as after the Christmas holidays a lot of tenants find they are getting evicted. Since bill 60 changed the eviction rules where a tenant must pay 50 per cent in the rent tribunal before getting a hearing along with must provide written documentation about repairs or maintenance issues. While the Socialist Democratic opposition opposed passing legislation the Progressive Conservative party is in majority position where was passed despite the profanity from the upper benches in the Ontario provincial parliament building in Toronto. About two per cent of tenants are problem tenants where the majority of tenants will remain who respect property. There are historic vacancy rates in Ontario in most major cities where now more rental units are going to become available. In New York they want landlords who have vacant rental units to put out signs where those rental units require major repairs and renovations where landlords can not recoup money with economically depressed rents along the property taxes and water sewage charges are going up where there is freeze on rent increases. Cities in Canada have mainly tax base from property taxes along with some provincial and federal grants which have conditions applied to receiving those grants where if those conditions are not met then those grants go to other cities. What is happening in the city of Toronto Ontario is there is election in 2026 where a lot people find road repair is a problem while the mayor has spent money funding causes which are draining city budget while at the same that money should have spent a road repair. One time a drove in the city where some of roads had bumps. When landlords have less money as result of being unable to evict non paying tenants there income is reduced where the amount of provincial and federal taxes paid are reduced then that effects the overall tax base along money that would used for major repairs and renovations more people are paying taxes which again more taxes are collected. Landlords buy materials, services in the communities where the buildings are located not a third country with low wages with no environmental standards where rivers and air is pollution occurs. This the mayor has no property tax increases beyond inflation to get elected again where doubt she will elected again the last year for Socialist mayor in the city of Toronto for a while. One time at the apartment building had five rental units not paying rent where the first was evicted with sheriff where the other four decided to pay instead of buying illegal drugs where drug dealers carry illegal handguns and have two vicious dogs. --216.110.xxx.xxx
