No but I would. I didn't know about this back when I didn't know what I was doing and had more tenant debt. We haven't had any in a long time knock wood.

Remember if you do you are "forgiving" the debt and can't collect on it later (although I guess you could just claim the income in that year?)

Remember they will only pay taxes and maybe penalties and interest on the amount, not the entire amount. --173.18.xx.xxx

I didn’t know about these things back when I needed them but wish I had. There also weren’t so many easy to use collection options.

I only sued on small debts when I was sued for keeping deposits and could just counter sue. I got better at people over time and no tenant in the last decade has been an issue. --162.204.xxx.xxx

As I see it, unless you’re a government agency or “applicable financial entity” required by law to file Form 1099-C (see “Who Must File” in the Instructions for Forms 1099-A and 1099-C on the IRS website, or 26 U.S.C. § 6050P), doing so would be unnecessary and mean-spirited, if it would just increase a former tenant’s tax burden without any benefit to you:

- It doesn’t get you the money or repair any damage done.

- If the tenant is still in possession, it doesn’t get them out any sooner.

- It doesn’t change whether you can take a bad debt deduction.

- If you do ever receive the money, you’d have more paperwork to do.

Another practical consideration: as the filer, your SSN or EIN has to appear on the form, and unlike the recipient’s, it’s not allowed to be truncated on any copy. That’s hardly information I’d want to share with a defaulting tenant. --76.81.xxx.xx

I disagree with the last post. A tenant that leaves owing you money for rent deserves much worse than an additional tax bill. The issue for many of us is that the time spent for small debts against individuals that may not be easy to collect from isn’t worth it.

It takes all of 15 minutes to set up an EIN and I have no problem sharing it with tenants.

Agree with JS, Banks use 1099C on short sales to ensure their books are balanced in an audit. If the short sale was caused by say a LOC gone bad, the person getting the 1099C got and used the cash already.

Banks are not mean spirited about this. Perhaps that money was used for a good purpose like curing Cancer, then again it could also been used for gambling or drugs --174.131.xxx.xxx

If you read the instructions, you will see that this document is made for financial entities. Not landlords.

I have never seen a case where an individual ever got a letter for not reporting a 1099c from a landlord. Only letters from credit card companies and banks. --98.34.xx.xxx

FYI if you do decide to forgive their debt & report them to the IRS & your state's tax office, you won't get any sort of financial gain.

I've done it several times. It didn't get me any money but I must admit that I did get a lot of satisfaction learning how difficult it made my former tenants lives.

My favorite was a tenant who rather than just leave decided to spray paint all sorts of lovely things on every wall in his unit. In our state these types of judgement earn 12% interest so knowing that he was uncollectable, I just let my judgement sit for serval years before I decided to act. When I decided to act I sent the 1099nec to the IRS, MA revenue office & him at his last known address. Since he never gave me a valid forwarding address, his form came back to me & was put unopened in his file.

It took a bit over 2 years for the government to catch up to him. Between the feds & the state they froze his bank accounts which resulted in numerous bounced checks & garnishment of his tax returns which led to loss of his job & eviction from his current place.

FYI This tenant makes $110,000 per year. She's a director of a program at the Urban League providing housing to the homeless. She knew every trick in the book. When she left she owed me $30,000. Mediation is mandatory in DC so I agree to forgive $10,000. I am 80 years old been in this business 40 years and this never happened before. I decided to let a Property Manager handle this and that was my mistake. I didn't work a job that gave retirement so rentals and a small Social Security check was my income. I had 3 rentals now I'm down to 2 because I had to move back into this one. Upon investigation she had done this to 2 landlords before me. It didn't come up in the DC Court case file until after my filing. She owes the 1st company $106,000, the 2nd $35,000 and me $30,000. The 2nd company is still trying to get the Urban League to honor his garnishment. --71.114.xx.xx

Look into the Mr. Landlord Boot Camp.

There are also many other resources on this site.

Also coming back to the forum to learn will help tremendously.

I was 20 years or so into this business before I started watching the forum. I figured I saved enough just from that to more than pay for the first convention.

Went to two of those and decided to go to the boot camp.

There had to be other signs. Credit rating?

This could happen to any of us if they had great credit and nothing on the reports. I’ve never seen it as I usually find a flaw but as a general rule when people work in the “business” I check more carefully. --162.204.xxx.xxx

JS, 20 years ago I never thought to check credit and I do not think the online for my state was available.

I think what Detra is saying that they know their system is flawed and need guidance.

What worked 40 years ago will not work in today's age unfortunately.
