Los Angeles California, February 01, 2020 THRU March 01, 2024: A landlord can not evict someone for NON PAYMENT OF RENT. That's 4 years. In my case $630,000 down the toilet. And when the ban was over, with attorney fee's and mandatory relocation fee's, I got cheated out of another $200,000.
Then in January with the fires, L.A. City and County enacted an ANTI-Gouging Law. Charge more than 10% in rent, then your last tenant in the property was paying--then you must pay that tenant a $10,000 fine. Now it's been raise to a $50,000.
I had an actor client, and "A" list world know actor call me. His house burned down in the January fires and needed a 2 bedroom apartment for his adult kids (in their 20's). So I offered him the perfect apartment for $1000 under market. Only $1500 instead of $2500 per month. 2 bedrooms, 1 bathroom knew kitchen, remodeled with a private back yard. Then the City passed the anti gouging law, retroactive, and assessed a $10,000 fine.
I took my tenant, his actor dad and the city to court. I had someone from Lucas Production, Disney and another studio. They proved to the judge that the father actor, only name on the lease made $3,000,000, from his part of Star Wars. And my old tenant had lived in the apartment under rent control for over 20 years, making his rent low. And as a person on social security, I didn't have the heart to raise the old tenant. So now I'm being screwed from all directions.
I lost the case, paid the $10,000 fine and then evicted the kids. One was smoking pot while the other had guest that parked in other tenants assigned spots without the other tenants permission or mine. They millionaire Star Wars actor then had to rent a similar apartment, on the same block, but for $4,200 a month. No dignity at all where this is about to expropriate private sector landlords apartment buildings then the apartment buildings slide. In Canada every town and city has building and fire code regulations where the worst landlord is the community housing (formally called the Housing Authority) where one government entity does not prosecute another government entity as some tenants when they called the building inspectors they never showed up. If a private landlord has serious problem with a apartment building the tenants can apply for rent reduction under rent control where the government owned apartment buildings are not under rent control exempt. One tenant who received a 45 per cent rent increase went down to the residential tenancy commission where found out he had two choices pay the rent increase or move out to private sector rental housing. One government apartment building it took close to four months to clear up the problem of inadequate hot water where private sector landlords replace heating equipment that is older as the heating equipment has reached the end of life. For apartment building with natural gas boilers or oil fired boilers it is easy solution where install stainless steel indirect hot water tanks then use the heating boilers all year round where with computer boiler control system domestic hot water priority where the heat is shut off for 10 to 20 minutes where all boilers can fire up a maximum capacity then slowly go down or shut off once the temperature in the hot water tank goes up then switch back to heating mode. Finally from the point of the socialist landlords do not have god given right to own rentals at all as this for profit. This was out of a radical tenancy advocate pamphlet. Recently after Bill 60 was passed in the province of Ontario where eviction process was changed where less time along easier to evict problem tenants was passed where the leftist political parties tried to shop passing where the Progressive Conservative Government is a majority position which means they have to depend on votes from the other three leftist political parties in the Ontario provincial legislature. The province of Alberta rent is free market along provincial government provides incentive to build and convert existing buildings to rentals. The is no rent control along with in Alberta they do not pay the 7 per cent provincial tax which brings down the cost of living along there a lot new construction in all types of housing. A landlord must earn tenants business which means a competitive along must maintain entire building to market standards along with treat customers respect. If the landlord fails to do this the apartment building become empty. Less government intervention less problems for tenants. The other aim is that when they finally do repairs they are of a high dollar amount and budge the needle on a permissable rent increase for a capital improvement. This does not affect me as I'm not neglecting my units in an effort to maximize income and avoid expenses. NE believe it or not there was no clear remedy for tenants before this without living through many months or years of no heat or water coming through a ceiling. I am with NE on this one.
At least around here, a tenant can always file against the landlord if the house isn't habitable.
The bigger concern I would have, is when the tenant takes and makes the place unsafe or unhabitable, so they don't have to pay rent. Then again, if you are buying in a location where they have such rules in place or for that manner in any way restrict the incoming flow of capital into an area, what kinda results would one really expect? There have been so many cases on here where a tenant does something so the place seems uninhabitable, turns the landlord in and then gets more free rent.
Yes there are bad landlords as well. I know a couple around my area that are truly slumlords. They make things tougher for people like me. It is a fine line to walk between letting the bad landlords have their way and letting the bad tenants do the same.

In the province of Ontario tenants can file for a rent reduction if apartment building is not maintained. Here a lot of landlords apply for a above guideline increase for capital expenditures where a 3 per cap on capital expenditures along no cap on other increases in operating costs that exceed annual guideline increases. The objective is to improve apartment complex while at the same time increasing rent along lowering operating costs by installing more energy efficient heating and hot water system As rents rise over time some tenants move out where vacant rental units go to market rent then over time the value of the rental complex goes up. The dignity is expropriation where once sell as bankrupt the city takes over then the next day rent control ends. With different types of left leaning governments landlords have fought those rules like licensing fees. If town or city imposes licensing fees where landlords with increases in operating costs that exceed the annual operating costs tenants will pay more rent. --216.110.xxx.xxx |
