Question
Our lease states a 90 day notification for when a tenant decides to leave our apartments. In one apartment we decided to rehab the kitchen before the tenant's 90 day notification was complete so we removed the ad and started the rehab. We are not advertising for a renter. The tenants are completely out of the apartment but have not returned the keys. Do we have the right to not pay back some of the tenant's last month's rent? --100.11.xxx.xxx |

If you have something in writing from them saying they are out, I wouldn't worry much about the actual, physical key.
I would, however try to contact them and ask about it.
If you do NOT have written proof that they are really gone, it's pretty gutsy to tear apart the kitchen when they still have possession. If the furnace at their new place quits, they could want to come back to sleep a couple nights - and would be entitled to do so.
When are the 90 days over?

No court order and no keys- you don't have possession. How do you know that tenant isn't away on vacation, and you did a self-help eviction on your own?
You are asking about paying back rent that has already been paid, even after you illegally took their home. How happy do you suppose that judge is going to be with you? I absolutely would not want to be in your shoes. Think this through before you decide to act further. If anything, you should be incentivizing the correct behavior instead of upsetting someone after doing something that might turn out to be one of your most costly mistakes for 2025.

Going forward, but it sounds as though you are getting ready to sell, I try to get them to sign a form saying they are officially out.
No I wouldn't reimburse them for partial rent if they left early.
