I told him I would not give him a key until he signs a lease and pays the rent. I read that someone gains tenancy in nys only after staying somewhere 30 days. I can't speak to NY law, but in Pa, he would be considered of having possession yet as the keys were not delivered yet. Since he did drop off his stuff though, you would have the duty to safeguard his belongings. Until when? Who suggested lying? Anyhow the officer said unless he had something in writing establishing he was a tenant, or he had been there longer, or claimed to be, he wouldn’t be considered a tenant. He could have claimed to have a lease, or had a fake rent receipt.
