I let an old friend stay with me for a few days and we talked about him signing g a lease as a roommate, and paying rent. The first has come and gone, and I have not received rent. I think he is a druggy cause he has been gone for days. He put his stuff in one bedroom and went out and put groceries in the fridge for himself. I told him I would not give him a key until he signs a lease and pays the rent. I read that someone gains tenancy in nys only after staying somewhere 30 days. Can I still put his stuff out since he hasn't followed thru with what we discussed. --76.38.xxx.xxx

I can't speak to NY law, but in Pa, he would be considered of having possession yet as the keys were not delivered yet. Since he did drop off his stuff though, you would have the duty to safeguard his belongings. Until when? In Pa we have act 127 that covers Abandoned property - I am not sure if NY law covers this? --174.131.xxx.xxx

Right now, he is "just" a friend who came for a visit & his visit is over.

I like plenty's approach. Add a little styrofoam cooler for his food.

Plenty---don't advise lying to the cops by saying he does not know the guy. Cops are good at detecting lies in situations. What's more, there is no need to lie, as even if he knows the guy the guy still cannot stay if he has not established residency.

Who suggested lying? Anyhow the officer said unless he had something in writing establishing he was a tenant, or he had been there longer, or claimed to be, he wouldn’t be considered a tenant. He could have claimed to have a lease, or had a fake rent receipt. He probably didn’t have time to concoct the story so the police didn’t think there was an issue for a judge to decide. --76.38.xxx.xxx
