This is the third person who, after I informed them that I would accept their dogs, then told me that the dogs were ESAs. Why do they bother after the dog has been already been accepted?

One girl had filled out the application, introduced the dogs to me, been told that they were lovely dogs, and yes I would rent to them, and THEN she informed me that they were in the process of being certified as ESAs. So, we then go from a complete application that I would start processing immediately to an incomplete application because I am then waiting for ESA paperwork before I proceed.

Again today, yes I will take two nice doodles, and then late in the conversation she informs me that they are ESA. Her emotional problem apparently involves her hearing because I told her three times that her missed mortgage payments might be an issue and that very obviously didn't register. --76.178.xxx.xxx

I call this the Three-Step-Process-Law. Do it in the wrong order and you've hurt yourself, legally.

First, you advertise and show your Rental to People. You have them complete an "application" and provide supporting documents. At this point "Forget about pets when it comes to vetting your candidate. After they "PASS" the Credit, Background, Income and Criminal checks, Then and only then stars the process for their 4 legged animal. Weather it's a PET or ESA animal--this is where you now screen the dog. Why waste your time until you find out the applicant has the income, credit, job history and money in the bank.

You see in California, an applicant has to have all of their dogs proof, at least 30 days old. Not all of a sudden getting letters, shots, etc. If you opened your fast mouth and let the "cat of of the bag", they you applicant may have had the time to "fake" or obtain BS Letters.

In Most of California, a dog MUST HAVE AN ANNUAL LICENSE. Around 30% of people don't pay the annual renewal fee. So if you want until after your credit/background checking, they any license will have a date, AFTER YOU OBTAINED THE APPLICATION.

Next you want proof, that the dog is vaccinated. Name of Vet and records, cancelled checks or credit card payments.

No taking a look-a-like dog to a vet and paying $29 for a shot. Remember these dog things have to be at least 30 days old in CA.

Next you want proof that the dog had abidance training. And passed. I had a family with a 6 year old that took the dog walking. If that dog saw so much as a flee hop, it would chase it dragging the 6 year old behind. Of another family had a ESA dog for 12 year old autistic boy. That dog would escape and kill neighborhood cats.

So when the applicant didn't have documents, I would put th dog to the test. Holding the dog on a lease, I'd order the dog to sit. Then I'd say. Bounce a tennis ball. Say Stay oce again and then toss the ball. If the dog took off after a ball, it failed abidance training. Imagine a 70 year old tenant walking down stairs. They dog is excited and wants to run up the stairs. The dog's owner can't control the dog and the dog won't listen to commands. ESA or no ESA dog. It could knock the 70 year old down the steps to her death.

Also there are other laws to evict ESA or pets because they are trouble for everyone else in the building.

I had an attorney move into my 7 unit in westwood. The dog wouldn't stop barking, when the attorney was at work. So using a manlift I went up to their second story balcony and snatched the dog. I drove it to the West LA High rise and give the dog to the receptionist. The dog kept on barking and the partners told my tenant he can not bring a dog to work. A dog that wasn't trained and barks non-stop.

So when that tenant attorney filed a claim against me, I counted sued all 27 partners and ordered them each for deposition. --47.155.xx.xxx

Require renters insurance and a qualifying credit score before they go to far.

Who is the agent's name where you have renter's insurance and fill out this credit app. so we can talk.

Doing it this method cuts out much of the nonsense phone talking and forces them to take action - or not. It requires you to have solid information sheets, a QR code and lots of pics or videos. Then again, these steps depend on who you are targeting. If you are looking for 80-year-olds, they probably will not know what a QR code is. --173.188.xx.xxx

You already allowed them in and yet they toss the ESA your direction?

Do you charge more for animals? That is the only reason I can see that they would even bring it up.

If you do not charge for animals then I would DQ them for poor communications skills.

As for the additional nonsensical story from robertj, do not follow his advise at all. Breaking into an apartment and stealing a dog is still illegal, even in CA. --107.147.xx.xx

RB, it seems easy to not allow smokers but not so much to not allow animals as it is if everyone and their grandmother has at least one these days. If you don't allow animals, then suddenly you get a whole bunch of ESA claims, and you have no applicants. As Brad, you may as well make money from allowing the animals but do the screening. It's a tough call. I would rather not allow them myself, even though I like animals, but everyone has them since you know when. --73.19.xxx.xx

Did you explain it doesn’t matter if they are pets or ESAs that you already had approved them? Quite honestly, I would find a more emotionally stable pet owner and avoid the emotionally unstable applicants if possible. I did not break into the apartment. I used a ladder from the rear parking area to the upstairs outside patio. The attorney tenant had allowed his dog to bark 24/7 while he was at work. Also when he came home, because we complained, he scooped up his dog droppings and threw them on the cars parked in the rear lot.

Since he knew the law and the police in L.A. are not help. I removed the problem and left him at work, the law firm, in L.A. --47.155.xx.xxx

I do not charge pet deposit or pet rent. Everyone has pets, so I just bake it into the regular ret and regular deposit. They are not doing it to avoid the pet deposit.

My pet deposit used to be $300 and the security deposit equal to the rent. Now I simply charge a security deposit that is equal to the rent plus $300. Tenants love that there is no pet deposit and I would have used their pet deposit to clean up any damage the pets did, anyway, so no reason to not just have it part of the regular deposit. --76.178.xxx.xxx

Oregon, in NYS the security deposit is one month's rent, full stop. So if you are charging an extra $300 it has to be labeled something other than a security deposit.

Robert J, I watch Dennis Block every weekend and he was mentioning that in order to claim "ESA" you have to have all your ducks in a row 30 days before submitting an application to a new place. What about existing tenants that presto, whammo, have the need for an "ESA?" --64.246.xxx.xx

This is getting so ridiculous.

Yet we as a group are supposed to cheer him on and ignore the fact that he committed a crime.

To make sure I asked Google is it legal to use a manlift up to second story balcony and snatch a dog in CA?

It is highly likely illegal to use a manlift to access a second-story balcony and take a dog in California without the owner's explicit permission. This action could be seen as trespassing and potentially theft or burglary, both of which carry legal consequences in California.

Others have been around here much longer than me and dealt with him.

Has he always been like this? That is a good clue as to some of the reasons. Having dealt with dementia in my family I unfortunately know a little about it.

But not having dealt with the same individual for a longer period of time I cannot guess as to whether it is dementia, lie-type story telling or just a troll to see how much he can get away with. --107.147.xx.xx
