My contract clearly states NO PETS in more than one place. Tenant gets caught hiding a dog. Even though I do not wants pets I make an exception if he is willing to pay a security deposit for the dog and monthly rent for the dog. He does not want to pay. I do the same thing as Plenty. I cut & paste the appropriate clauses, issue a Notice of Violation of those clauses via email, and the time to cure (some are 5 days, some are immediately.)
If they seem like they are "oh gosh sorry" and cooperative, I give them until the date. If they ignore me, I would be filing for an eviction right away. --173.28.xx.xxx |

Never make accepting for those who lie, are sneaky or don’t respect the lease. My leases have an automatic $500 fee if an unauthorized animal is found on the property and is subject to immediate termination at my discretion. I would serve a cure or quit notice and fine them. I typically cut the fine in half if it’s paid promptly.
I’ve collected twice and the problem has never happened again. You have to be firm, even with the better tenants. Yours doesn’t sound like a good one.

Just curious, how long ago did they move in? If it's been a while, have you done an inspection on the place?
I'd cut my losses and get them out. They clearly feel entitled to do what they want and then when they got caught, they're not going to pay extra rent for the dog.
Charge them the extra for the dog. When they don't pay, their rent will be short. Then start eviction for failure to pay. --73.2.xx.xx |

Well, connie MI: You've already got some good advice on what to do now. Stand tall & enforce your rental agreement. Of course, none of us know what it says regarding this situation and the consequences - but all you can do is enforce your written agreement.
Going forward, Consider these:
> refer to all animals as "animals", not "pets" (see Kim's comment)
> Add a clause saying that all money received is applied first to the tenant's outstanding balance, then to the current rent due. (alluded to by Tim)
**I recommend that, even if this isn't already in your lease, include these terms in your notice to cure (& notice to pay the penalty fee, if you have one)
> I also agree with Lisa regarding an immediate, significant financial penalty. (due before the next rent is paid - see above)
> Never make a threat - something you are not going to follow through on. Only give notices of what WILL happen if there is no compliance.

here in Tx it’s 3 days cure or quit. the issue will be if an esa (not protected) or a real service animal and you can ask what they do. and if answers are legit then you cannot not allow. we deal with this all the time at the hotels by people not wanting to pay animal fee. --104.28.xx.xxx |

Me? My lease is clear: $500 instant fine for unauthorized animals.
We add it to his account immediately. Another $500 for each month the animal is still there.
We LOVE pets for the extra income so IF you visit and approve the animal we charge $150 Non-Refundable Animal Registration Fee and $35 per month, retroactive to the start of the lease.
Never take a pet DEPOSIT because
1. You will have to return it even if they owe rent
2. People will simply pay the Non-Refundable Fee and you make money.
Managing is an active sport. You must be bold and play the game. The clock is ticking.
