Hi,
Just curious, can we disqualify prospects if they had sued their landlords or filed a personal injury case as a plaintiff in the past? I was sued by a tenant who felt in her own kitchen a few years ago. It was a stressful time. I searched her name after she filed a lawsuit and found that she also sued her previous LL as well. Lesson learned. Since then I added another criteria to disqualify any prospects who sued their LL. Now I have another prospect who sued a casino for personal injury. I don't have the details. I guess she must have slipped and felt. Anyhow, by laws can we DQ prospects based on this? Or do we have to find other reason to DQ them? Please share your thoughts. Thanks.

As noted, not a protected class and I would definitely DQ because once they KNOW the system, they are more likely to use it.

I would DQ for a suit against a LL for sure, even if it was a known slumlord.
Now as for booting them because they were filed on I can't do that. There are some landlords in my area that file because they want the place back. Maybe a legit sale or family moving back in. Doesn't make sense to me. Just give them notice of non-renewal. Then again, maybe that is what happened and the tenants chose to not leave without a court order.
Tough call on that one.
Now if they owe a lot in damages, or even a small amount and aren't paying then they are definitely disqualified. --107.147.xx.xx |

zero[IN], eviction is expensive. Tenants must be resisting or difficult to work with for LL to file an eviction. Any eviction record is a DQ for me, doesn't matter who's right or wrong.

For me, a civil lawsuit (on either side) is not an automatic DQ. I would check the pleadings first to see what it is about. I'd also want to know who prevailed.
A lot of tenants have been involved in fender-benders, and I see no reason to DQ them for that. We live in a sue-happy culture.
Even if a tenant sued his prior landlord, it might be justified. I knew a family whose landlord had accessed under-slab drain pipes in the living room, and the LL left a 6 foot deep ditch in the living room. For months. The T sued. And won. I accepted this family as tenants, and they were good tenants.
