State Specific Question About: TENNESSEE (TN) Can bad and ignorant money-grubbing HOA board members hire a corrupt money-grubbing property management company who comes into the subdivision and charge almost $1000 a year to the homeowners in that subdivision who are renting out their property? This includes senior citizens (one being about 90 years old) and veterans? They dreamed up some excuse to try to justify them taking part of the rental income from these homeowners by saying it’s administrative fees and according to what they said, they’re going to split this stolen loot between the two of them—the HOA and the property management company, which I looked up and it is as corrupt as Hades. It looks like they have no good reviews except the ones they put on there themselves. The HOA board members, obviously, did not do their due before hiring these crooks. As a Realtor, who is very capable of managing property, I have been managing that property for almost 10 years and have needed no administration nor have I needed to pay any administrative fees. In getting my business degree in college and taking business law, I learned that there have to be certain elements involved in a contract in order for it to be a contract. If only one of these elements is missing, then there is NO CONTRACT. One of these elements is a “meeting of the minds” (sound minds) meaning that all parties involved in the contract have to be of sound mind and agree to what is being said in the contract. We never agreed to this, and we never signed anything to agree to this. Also, this has caused hardships to the renters like my renter that’s having to move because he can’t afford the additional rent every month that’s passed along to him. He has a senior citizen mother living there with him who is in bad health, so this is uprooting and causing hardships to the renters as well as the homeowners. --52.15.xxx.xx

HOA have power. Yes they probably can do these things. Review the HOA rules and regulations and bylaws. We purchased a home in March, unbeknownst to us the HOA has been getting organized and we're not allowing rentals. I followed the rules and ask for a variance. Which was denied. We sold the house in June after three months of dealing with them. Having been on several boards I will say Yes they can and the judge will agree with the HOA. Sell now and get away, cause they will fight with legal expenses that get passed on as special assessments. And you'll pay. And you'll be wrong. You'll not win. --172.59.xxx.xxx

When you buy a Condo, you agree to follow the rules that the HOA passes. So why are you not happy after agreeing to follow the rules that they are passing?

Thank you for your response, but I will say, and I think most people would agree with me, that that was a very stupid question. Would you want to go along with giving a hunk of your rental income to these money grubbers, especially if you were a veteran or senior citizen almost 90 years old and especially since you’ve been doing it for the last 10 years yourself as a Realtor with absolutely no justifiable reason for them to steal this money from the property owners dividing this stolen loot between the two of them.

Remember what a-s-s-u-m-e does, and you just assumed that we went along with that. Did you read the contract yourself? I doubt it. We don’t want to make the mistake of assuming.

I do not agree with you Joycw. This is how HOA stop the rentals. Perhaps there are too many rentals vs homeowners in this subdivision. This can cause folks not to be able to get FHA financing. Sone believe having a rental vs homeowners changes the demographics of a neighborhood. HOA have a job to do, if they don't do that job they can face Judges rules. If you have a rental home in this neighborhood, sell it today. You'll disclose the rules for no rentals or if you do rent these are the new terms. The HOA doesn't want rentals. If you've had ten years of history renting this home that's great. You also have ten years of appreciation. The future is here today, the vote was counted, the residents have spoken, the board will now have to enforce. I have 30 years of HOA board positions, in four neighborhoods. Give your renter's notice, end the contract and prepare your home to sell. If you stay you'll pay and loose what you're gain. --172.59.xxx.xxx

So it is sounding like you are one of those HOA board members that gives HOA’s a bad name. I have been on the board of an HOA and we NEVER had any problems with any of the property owners for one simple reason, which was:

We worked WITH the homeowners—not AGAINST them knowing

that we did not discriminate against any tenants there (which is illegal) because we knew the issue was NOT whether the resident was a tenant or an owner but was all about the upkeep of the property and the neighborhood. We know that some renters do a much better job of maintaining the property than the owner. And, since we had a level of decency, we would never punish the elderly homeowners or the veterans by sticking our noses into their rental income stealing a large chunk of it.

One thing that I need to do now is ask some questions to my CPA. Due to this topic being taken off track in so many ways, I would like to call a halt to the responses. For example, there is too much assuming, i.e. assuming that this is a condo, and too much misinformation as the last response stating,

“If you stay you'll pay and loose what you're gain.”

If this is how limited this person is on the options,

I am glad that we never lived in a subdivision where

this person was on the board. Again, this is the attitude

and lack of thinking outside the box that makes HOAs

look so bad.

Sorry, you can't do that either. HOA have rules, the board has to follow the rules. You may Google such and you'll find the Judge will back the board and the bylaws. That is working with the residents. That is their job. This HOA doesn't want rentals and they will work with you in as far as the restrictions allow, so pay them or sell. The last HOA's had their rules written in regards to rentals is that they would collect 100% of the rent! That's tough. And you can not stop my comments. Yes the last HOA passed a bylaw to collect 100% of the rent from owners who are renting their homes and do not cease. I did not get to vote on that, I would disagree but that is what they wrote up and they voted into their community. I agree with you that working with folks is best but they do not have to Grant anyone a variance. And the turned down my hardship twice. So we sold the house just this pass June. We are all here to learn and exchange experiences. If you'd like to obtain more education there are several opportunities on this website for additional training. I'll save you a seat.
