State Specific Question About: INDIANA (IN)

Have a judgement against a former tenant; they bought a house in a neighboring county. We filed a lien against the house in the county where it is located. We have had former tenants who bought houses in the county where our property is located and it is automatic when they try and sell the house the judgement shows up and they have paid. Pretty sure it does not work that way if the house is in another county.

The 10 year anniversary is coming up in September. Do we file a proceedings supplemental on the original judgement to try and get the money they owe? Do we have to file a new claim? Would it be better to file a new claim in the county where they own the house?

Anyone else ever had this situation?

We also have another tenant who did the same thing a couple of years later. We went through getting the judgement, and then filing a lien in the county where they bought the house. It would be nice if we get the one coming up in September done, so we will know exactly what to do when the other one pops up in 2027.

you need it filed in the county where the house is or they wont pay it upon sale because it wont be attached.ask the county clerks office where the house is located what to do,you can probably take a certified copy from where it is filed to the new county and file it. in my state the judgment itself is good for 20 years but only attaches to real estate for 10 years so it can be refiled for another 10 but i would do it before it runs out.you can always start a foreclosure action, a letter from an attorney will get there attention --98.96.xxx.xxx

I would turn it over to a collection agency. Take the hit from their commission and be done with it.

The lien only works if they try to refi or sell. I have one sitting like that. I am hoping that when rates drop she will try to refi and have to deal with me again. I am not hopeful that this will happen tho.

When I have damages owed I never plan to see any of it. I turn it over to collections and let them deal with it. Sure I have to pay for their letters and new proceedings but as long as I know the deadbeats are remembering what they did I am good with it.

Remember that you can collect 8% on the past due judgement as well.

I am lazy tho. I figure that since the lawyer has to stand by me for court (I'm an LLC) then I just let him deal with it all.

My job is to get good tenants in and keep the places cash flowing. When I have an eviction it is a slap in my face. I pay the price for learning what I have done wrong and move along.
