Hello Everyone,
I have several trees that border my neighbors property with my rentals. Some are so large that the limbs extend over the roofs of houses next door. Who's responsible to cut back the limbs as needed? The second question I have is when a tree in on the property line who owns the tree? I thought some of you may have already dealt with this issue. Have a great day! --108.250.xxx.xx |

If your tree hangs over a neighbor's house, it's my understanding that the neighbor is responsible for trimming back anything that extends beyond their property line. But not everything needs to be by the book...good neighbors take care of one another. --140.209.xxx.xx |

Last year I had a tree at one of my properties topple over and land smack dab on the neighbor's truck. I knew I wasn't at fault, but I played along and gave them my insurance info so they could be the bad guy instead of me for once. The insurance company told them to pound sand and that we weren't liable. So no, unless you've been put on notice about a dead limb you aren't liable. --140.209.xxx.xx |

Here in California, Trees Section 833, spells out all of the rules governing trees. But laws are not worth the paper they are printed on.
I took my neighbors to court. Judge asked if any of us had our property Lines surveyed? My neighbors, husband and wife and both lawyers. So I presented a survey I had commissioned, at a cost of $675. Showing the tree trunks were 100% on my neighbors property, therefore my neighbors had to trim their own trees. Judge ruled against me. So I had to pay to trim my neighbors trees that put my property in danger.
A few years later those three grew back, and a major tree branch came crashing down on my neighbors pool, costing $200,000 to replace.
I've had 7 lawsuits because I followed the laws, but neighbors refuse to pay or take responsibility. --47.155.xx.xxx |

Had a massive 3.5 ft diameter "beast" on my property line branches threatened me AND my neighbors house. I said "lets split the cost to remove this thing before it hits one of our houses. He said "No, we like the tree".
Soooo I hired a tree company to aggressively remove the branches threatening my house. Now it was his problem. The beast was so heavily weighted to fall his way.

We had a very similar experience as TRYAN. Neighbor who is arborist mentioned a limb from our tree was swaying in high winds. It reached through the next door neighbor's house close to the neighbor next to him. Hubby wanted to take it down and told the neighbor. Neighbor said if we took it down he would move (which none of us wanted). I didn't want to cut it down as I was aware that neighbors can trim tree limbs if they are concerned. This neighbor liked to climb our tree and had placed a hammock to sleep in, which is why he wanted the limb to stay. What I did was hire a tree trimming company to do what TRYAN did so both properties were safe. Then the neighbor used some climbing ropes to properly secure the limb from swaying. Neighbor was happy and we are happy. A better outcome than TRYAN's new neighbor. --75.11.xx.xx |
