In almost 30 years of being a landlord, I am having my first eviction. Tenant is a PITA, 45 year old male who complains about literally everything and anything and all things. He doesn't only complain to me about his unit, but to the utility company about his bill, the postal service about the mailman, his job about hours worked, the neighbors about noise....the list goes on and on and on and on..

I know I am a super nice guy, and I have dealt with this tenant for way too long and I finally reached my DONE point.

He is on month to month. Gave him his eviction notice May 15th for a June 30th eviction date. This gives him a full 45 days. He has called me and texted me multiple times since, begging me to give him another chance. I will not change my mind.

I don't think he will destroy anything in the unit, I do have a feeling on July 1st, he still will not have moved.

Should I just wait to find out or should I remind him he has 3 weeks remaining. ??

Eviction is when you go to court. Termination is when you give notice. Take it easy, don't fret, let the time pass, and see if you need to escalate to eviction if he doesn't comply. Currently doing a notice of nonrenewal on a single mom I gave a chance to against my better judgment... right there with you. :) But yes, I notice that my weakest tenants seem to have the most to complain about.

I assume he paid june rent? if not it is a non payment eviction.I would not communicate with him,he knows when he needs to be out,any communication plays into his hand and will make him think he might be able to stay. --208.115.xxx.xx

I agree with others that YOU have not given him an eviction notice, you have simply notified him that his lease will be terminated at the end of June.

If he has NOT paid the June rent, I would begin a COURT eviction as soon as the state law allows me to - this means you may have to give him a pay or quit notice or something similar.

You can have a plan in place in case he doesn't move but for now just sit back. I tend to call utilities about a week prior to see if there is a termination date. That tends to clue you in. I do NOT put utilities in my name until I know they are gone. --73.230.xxx.xx

If you own house or rent utilities are going cost where you pay. Life is not for free where you pay taxes along with everything else in life. I have difficult tenants where after the above guideline rent increases they moved out then in future never heard a complaint about rent. You could plan to use an eviction attorney if the tenant has not left. Look for recommendations on this forum for your area or on other sites. You could look for information on a Pay-or-Quit notice and the procedure for your area too.

I used the same phrase on his FAMILY who were calling, crying and begging: "I am too old for the stress that man caused me. He's your son, your brother: you deal with him because I will not."
