addendums to lease (by nance goldstein [OR]) Posted on: Jun 5, 2025 9:20 AM Message:
State Specific Question About: OREGON (OR)
Hello, I am preparing a new lease for sitting tenants in Portland OR, for their renewal after living there many years. Portland OR has a LOT of addendums. I'd like to know if it is legal to reuse previous addenda - that is, a copy of each previous addendum with a space for them to sign and date again NOW.
IT would save a lot of time for everyone. And more important, it would show the tenants that this is exactly the same thing they signed many years ago - no word changes, no additions. That would make it simpler for them AND they would trust the documents.
thank you. nance --73.68.xxx.xx |

That's a tricky question since I'm not in OR. I use a similar approach if I add or change tenant roommates. They are added on the addendum with the date and my initials circled. When soneone is subtracted I just cross them out, dated, initialed. --75.11.xx.xx |

Not sure about your state but if your lease has been updated, start fresh. Posted here a while back was judge discounting addendums, so make it a lease item. That's what I did for damages --172.59.xxx.xx |

Thank you SMALL. I never checked with anyone whether it was legally correct before. When signing some contracts in the past,I was told by the lawyer "tips" I thought were legal help...i.e., initial the bottom of each page of a contract so someone can't modify the page then just switch the original out. Also to initial and date changes to a contract. --75.11.xx.xx |

Again, your state, their rules, but we list our addendums in the lease and the lease refers to them and incorporates them. --173.28.xx.xxx |

Have you checked the most recent version of OR landlord/Tenant laws?
I don't know how old your addendums are, but it seems there have been lots of changes everywhere in the last few years.
You can find a link in the upper, left area of this page:
"Landlord/Tenant State Laws" in blue font.
Or google Oregon landlord/tenant laws 2025
As WMH, I would refer to them, incorporated them, and send them all as one document for signatures (one packet via Docusign) --72.218.xx.xxx |

I do the same with my addendums as WMH does... mention them in the lease (with check marks indicating they ARE part of the lease or "N/A" if they are NOT part of the lease (suck as pet agreement) so this way, (hopefully) all is included).
It makes the total lease about 21 or so pages (with the addendums) but some are required by my state (NYS) so whatever. If a judge throws out my addendums I guess I would have to say "well, what about the ones required by NYS?"
Food for thought (such as lead disclosures, etc that are required by the FED).
