I have a tenant who wants to have a friend move in for 60 days, then possibly be a roommate. This is a good tenant. If I ok this, what is the best way to go about it . Tenant is MTM but I do t want to redo all the lease paperwork and then redo it again in 2 months. That seems the only way to make it jointly and severally in case good tenant moves out and friend stays behind. A Not going to raise rent as they already pay market rent. I don’t know that a long term guest addendum matters since anything over 14 days means they are a tenant. --68.191.xx.xx |

I'd end the existing lease and set up a new lease with both. I don't know how MA works but not having someone on the lease in PA could mean going through an ejectment process rather than an eviction. That's an interesting question that may have a different answer in MA from many other places in the US given their tenant leaning laws.
Is there an advantage to keeping this person as a guest in MA? I know the courts make it extremely difficult to evict there. Do they give the same consideration to a squatter? In essence, that is what this person would be if your tenant moved out and they stayed. If it's faster to get a squatter out then keep them off the lease.
Conversely, what if they simply move in without your permission. Could you evict? If not, then it may be mute point anyway because the State has taken away your rights to remedy.

Does the Tenant not know the Guest very well? Are they doing a trial run as a roommates?
Will you end up getting involved if it devolves into a bad roommate situation and first Tenant wants you to take care of it?
I'd tell them a GUEST is 14 days or less. Any more than that and Landlord/Tenant laws start to apply and they may find themselves stuck. Be honest with them - they may not know. --173.28.xx.xxx |

60 days is not a guest. That is a tenant, If nothing else, they should fill out an application and be properly screened.

Anyone over 18 staying for an extended period needs to be vetted.
I have allowed friends to come in without being added to the lease, but only after I run a criminal/background check on them.
This has saved me from dealing with the eventual break-up.
If they all go bad when I file eviction it states the tenant's name and et al or other wording to mean anyone else living there.
