Tenant did not pay full rent last month so I added a late fee according to lease. They did not pay what was owed last month or this months rent. Can I charge a late fee on the entire balance due this month including the balance from last month and the late fee from last month? --97.101.xxx.xxx

Mine aren't allowed to build on each other and accumulate. Each late fee references the amount that's late in the month that it's charged/generated, rather than the cumulative total/rollover total if they're carrying a debt because life is upside down for a bit and I've chosen to work with them.

I make an excel sheet amounts due, date, amounts paid, date, late fee applied... Keep good accounting records. Share with tenant. And yes read your lease and follow your state laws in regards. My state is different. --172.59.xxx.xx

In my state with my lease, I would have applied the money they paid to the late fee FIRST, then issue a pay or quit for the balance owed. If they ignored that, I'd file for eviction immediately. --165.85.xxx.xxx

Similar to what Jason [VA] does, my rental agreements have a clause stating how monies received are applied. So any prior unpaid items including late fees, unpaid rent, repairs, etc would have the latest payment received applied to those first then if there was any money left over it would be applied to their current rent. If they didn't clear up that remaining balance then when legal to do so a new late fee would be applied to the out standing balance. Unfortunately in MA rent is not considered late until 30 days past the original due date. --71.174.xx.xx
