Just had a couple apply for a vacancy I have coming up in July of this year. This was my first showing and they completed an application. Everything checked out okay--ccap, prior 2 years landlords gave great references, credit report A+. So here is issue. They texted me today to let me know that they received the lease, signed it and will be sending it back. When they did the showing, they asked if 2 cats were okay. I said, yes. No problem. So today, AFTER they texted me that the lease was signed, the girl sends me a text message with a link stating that the two cats are ESA. I reviewed the letter. It is dated 4/10/2024 and it states it is good for a year. I'm in Wisconsin, and the address on the letterhead is from a company in California. NOw I know that a lot of companies in today's world, contract with out of state insurance companies or the companies that you can call to speak with if you're having any personal issues (can't think of the name of it right now). But my issue now is that I feel she was deceptive, and if she is deceptive now, she will continue to be deceptive. Am I reading into this too much. But if you don’t have anything else to deny for or if they provided animal info on the application, you may be screwed. You CAN deny the esa claim because the letter expired. Keep it super vague “unfortunately we are unable to accept these esas because the provided documentation doesn’t meet hud’s minimum requirements” and then say no more. In my case, they left the animal completely off of the application, so I made them fill out a new application with ALL of their info. There were inconsistencies between the two applications so I questioned them on it. She said “oh my dad filled out the last application for me”. The letter states that she has some difficulty coping with day to day situation and the presence of these animals helps mitigate the symptoms that she has and that each animal helps mitigate symptoms independently of the other.

In California, if an ESA or Pet has a problem, you are allowed to demand the tenant get professional help. Obedience training, etc. If the owner/tenant does nothing to curb the cats attitude, then you can ask the tenant to "REPLACE" the broken cat with a one that is better behaved.
My tenant took her old roommate's cat without permission. This "cat" hates other cats and "men". So when I came to the property to collect rent checks, this cat broke a hole in the fiberglass screen and set out to attack me.
I love cats but 1 in 25 cats develop a non-treatable brain issue. So with the cat biting my hand and scratching me, I jumped in to the neighbors pool and kept kitty under the water until it was no longer a problem.

The pet rent is X until they satisfy your requirements.
For me if they give me this I accept that they are an ESA
To have an animal be considered in your rental application as a support animal, you must include the following with your filled-out application:
1. A written request for a support animal as a reasonable accommodation.
2. Evidence from your healthcare provider of a disability and that you have a disability-related need for an assistance animal.
Misrepresentation of support animals is a Class 3 misdemeanor (N.C.G.S.A. § 168-4.5)
I have one lady who provided the information and her daughter has a support dog. No problem.
If it was me I'd accept if for what it is but at renewal time I'd ask for an updated copy of their ESA letter and raise their rent enough to satisfy my feelings of betrayal. If they have been model renters it would be modest and if they are hard on the house it would be significant and if they don't like it they can move.
Sounds like they can afford the rent.
I will say I have a doctor in one of my units and he is always late with the rent and never can seem to get me his declaration page for his renter's insurance. He also can't seem to mow the yard on a regular basis.
He got a significant rent raise for being one of my problem children. He pays (still late by 4 days) without a squeak.

If you live and own property in Los Angeles, almost 20% of all Housing rules, codes and violations are illegal. They only want to Tax landlords to death. No allowing evictions for non-payment of rent for 4 years, and starting it again after the fires.
Animal control does nothing to help those in need. Only after a dog has bitten a dozen people will they take notice.
If anyone calls 911 for the police, no one will answer the phone call for 20 minutes to 3 hours.
If someone blocks your driveway and you can't leave, calling Parking Enforcement is a crap shoot.

Is she trying to get out of pet rent and pet deposit? That is why I just bake those into the regular rent and the regular deposit, because that does away with most of the ESA nonsense.

Yeah, I'm not getting the issue here. They stated up front that they had them. You said it was fine. Then they clarified that they were ESAs. What is the problem exactly? I don't see any real "deception" here. Deceptive people wouldn't have asked at the showing if 2 cats were fine.
Also, you should ignore Robert S's posts. He often "embellishes stories" (i.e. lies) about things here. You are new, so wouldn't know. But basically ignore anything he says because he just makes stuff up regularly.
As for NE's post... I see no problem advertising in May for a June opening. Good tenants need time to give notice and move. People that are able to move on less than a month's notice are usually more trouble than those who plan ahead. So, I'd say ignore that too.

Ken: I'm looking for perfection :) haha. However, I have 6 units and out of my 6, one is an airbnb, so that is different than the other 5. The one that is going to be vacant in July (the one in reference), the current tenant has been there for 10 years. Is 72 or 73, from California. Goes back and forth to Cali frequently (like every other month or so), the place is spotless, always pays the rent on time or a couple months in advance. Doesn't have a car so walks to where she want to go. I truly lucked out on this one and maybe my hopes are high right now because of her. She is a model tenant and 99% chance i will not find another like her. I have another one that's a close second. She has been in her apt for 14 years, not one late rent payment, and her apt is spotless as well. AND she is pleasant to me. The couple that lives above #1 and the one that will be vacant, have also been there for 10 years, no kids, no smoking. The woman has her masters in psychotherapy (so maybe these two will get along well :), never a late rent payment, are trainable on certain things, but all i n all good people. --104.231.xxx.xxx |

I have a strong bias against applicants who claim ESAs because 95% of the time, they're just trying to avoid the pet fees/pet rent.
That said, I have a friend who is having a hard time finding an apt to move into and has two dogs, one of which is an ESA. I think in his case, it's legitimate--he suffers from almost paralyzing depression, and sticking around for his best friend is the only thing keeping him among the living. But he has changed his approach to NOT describing the one dog as an ESA because he doesn't want to get tarred with the same brush as people gaming the system.
I think if you deny them, you could be the target of a lawsuit. Perhaps you could send them Jason's phrase, but add, "However, if you would like them included as pets, we would be happy to move forward with your application." I think Ken makes the most important point: you are walking on thin legal ice if you deny them now. You accepted them. They had already told you that they had cats. And now you're thinking of denying because they told you the cats were ESAs.
You can argue all day here with other landlords that you want to deny because they "deceived" you in some way. But good luck with that argument in front of a judge in a discrimination lawsuit.

I'm in full agreement that she's stuck with accepting them, however she doesn't have to accept free pets. This was manipulation on the tenant's part and Marcia has every right to be concerned.
Combining mine and Robin's suggested approach, just reply back
"Unfortunately the documentation provided doesn't meet HUD's minimum requirements for us to consider this as an ESA. However, if you would like them included as pets, we would be happy to move forward with your application."

There was no mention in the beginning of any difference in price for pets. Marcia will need to clarify on that.
Also, WI has a 1-month limit on security deposits, so Jason's idea doesn't work here.

So, again, to me, this isn't a big deal. We've all dealt with LOTS AND LOTS of ESA people over the years. We all agree that most of them are fake anyhow -- it's just something that we have to deal with.
But you know what very RARELY happens? They tell you up front that they have 2 cats. This is not what deceptive scammers do when there is no pet fee. They don't gain anything significant by telling you later that they are ESAs! If you had a pet fee, then that would be different. But you don't. So there isn't even a reason for them to tell you that they are ESAs.
(Ok, technically, to avoid the extra $250 "refundable fee" (which is poorly worded, just FYI). But that doesn't seem to be their end goal here either.)
So I'm still on the "I don't get the concern" bus here. They didn't gain anything. There is nothing to scam. They can have two cats for free -- so why bother lying about them being ESAs?
Heck, why does it even matter that it is expired at this point? It doesn't seem to matter that they are ESAs at all, right? Again, there is no gain for them. That is NOT the behavior of an ESA faker that we've all had to deal with in the past. These people were immediately up front about their cats. That isn't what ESA fakers do. There's no scam to be had in this situation.
The only thing I will say is this because I'm picky about the legal side: even if she is "in agreement with the pet fee of $250", you can't legally charge her one for ESAs. It sounds like she doesn't realize this either -- so if you want to do it anyhow, that is your call. But from a technical standpoint, once you learned they were ESAs, that was the only thing that changed: your ability to charge to "pet fee" for them.

NE: I've moved on from Medical students and that "niche". Mainly because they don't stay long enough. I still advertise 3 months ahead and get professionals that stay as long as Marcia's many times. Doing so allows us to plan vacations and live our life. When someone comes my way needing a place within 30 days I see them as desperate, and I don't want to move that fast. Been there, done that since my 20's, now in my 70's.
Have you ever tried it to see your results? I get the security deposit and first month's rent with the lease signing, which I do within a week. So if they disappear, they lose. --75.11.xx.xx |

This isn't the out that you think it is unless you've already rejected the previous two cats as emotional support animals. The applied with two cats, you accepted them. Then they claimed they were both esas. If accepted, that resets the counter back to zero so now they have NO pets. This extra cat would now count as ONE pet, which is less than the two you previously accepted.
You need to write down your qualifications and stick to them because she's playing you right now and it seems as though she's winning. Do you have any criteria based on age or whether the animal is fixed or not? Once again, with new information, she should be made to fill out a new application.

Without knowing every interaction that you've had with the tenant, I would simply reply "Unfortunately, the documentation you've provided does not meet the HUD guidelines we must follow for accepting an animal as an ESA. Therefore, the three animals you've indicated exceed our maximum limit. Thank you for your interest and good luck with your search!"
Block her and done. Do not under any circumstance get into a back and forth with her otherwise it'll be "Ok, we'll just get rid of this one" or "What do we have to change for you to accept the letter" blah blah blah.

There is no legal limit on the # of ESAs a person can have, but the medical provider must state that each one provides a distinct service that the other(s) do/es not. So you might have one small dog that snuggles with you to help you sleep, and a pit bull that makes you feel safe against intruders.

UPDATE: To those of you that were following this post and/or replied. I ended up denying the couple based on the fact that they now had a third cat. I checked the city ordinance for the number of animals and it was 3. There was no pushback from them (at least not yet). Just got a signed lease this morning from a single guy, been at his job 12 years, >100K for income, one cat (not ESA). Seems like a great guy. --104.231.xxx.xxx |

I once had an applicant who produced a letter from her psychiatrist (on a company letterhead - and the medical center verified with a Google search that it was a legitimate & licensed firm). The psychiatrist certified the applicant had PTSD and required BOTH a service animal and an ESA. There wasn't much I could do about it at the time, for her mom was an attorney. After she moved in, it was clear the service dog wasn't properly trained to be one (Both dogs were raging lunatic wild animals, who used the apartment as a racetrack.) Competent individuals I sought advice from told me there wasn't much that could be done, expect to boost the rent at renewal time (which I did ... at an increase of double the amount I'd normally do). Naturally, she moved out -- but not completely until 1 pm on the 1st. I had people waiting to move in, and the apartment was filthy. I had to credit the new tenants $440.00 for their inconvenience and helping whip the rental back into shape.
