This place is so helpful , I wonder if I may ask another question?

Have an older tenant,..she has been miserable to deal with ,.a section 8 tenant and feels the government should provide free rent for everybody,.. and resents her small part of that rent,..Nice apt but if any little things goes wrong she yells

"I PAY RENT! " ,..well,... at least her part which somehow she got what she pays,.. reduced,..

Now I would like to get rid of her for a number of reasons,.but That's not easy in Ma,.She senses that we will probably push for that soon.and told others in the building that she would not go w/o a fight using free lawyers and making claims of not fixing things,harassment (not true ) etc,

So our repair guy says he always sees a cat in her unit we have a no pet rule in our rental contract,..also no smoking in the rental rules as well, he sees ash tray and cig butts she uses the center room of this 3 bedroom unit for that as well as a washer/dryer she installed,... Can any or all of these be used to get her out?

So I'm wondering if I can just give her a notice to vacate without an allowance to cure. I THINK you have to cite a reason for getting a section 8 tenant out, in Ma.

Don't know the answer to your question as I don't do section 8, however, this is exactly why section 8 and other government programs should not exist. It creates entitlement. Extreme entitlement. --73.19.xxx.xx

You need to check with MA landlords, or maybe a lawyer, but can you not simply not renew the lease? Or else raise the rent so high that Section 8 will not pay it?

In future, more screening and do an in-home inspection before accepting a tenant. That would have caught the cat and the smoking. --76.178.xxx.xxx

The easiest way is to simply raise the rent above what S8 will pay i.e FULL market rent. Then when housing says they will not pay it you say "she's out ... help her find another place". They will stop payment and you'll have the eviction for non payment. Hopefully housing finds her a place and she moves peacefully.

I got this from the housing director in my hood.

I've done a lot of S8 over the last 40 years.

Unless their behavior is provably egregious, you have to wait for their annual lease renewal date. Give 60 days notice prior to the lease-end date to the tenant and Housing Authority. DO NOT GIVE A REASON - it will only be used against you.

You can site the lease violations but I don't think S8 (or the courts and legal aid) would "care".

I'd do what tryan is stating... case workers will (should) tell you what they will pay for apartments (I wouldn't necessarily tell them who you are or the addresses, etc. Maybe say something like "I'm thinking about opening up a few of my apartments to S8 and I wanted to know what you would pay/ the threshold is for them. They are (1 bed, 2 bed, 3 bed, etc) and they will tell you what their amounts are. You can also go to the HUD site and find out for your area/ county what rates they would pay. If you go over it, then they will ONLY pay the max of what they are allowed to pay. --67.253.xxx.xxx

MA is unique .... I had ZERO success evicting for something other than non-payment. The courts simply will not play the parent between two kids fighting.

Once heard a judge say "I will NOT put a family in the street to facilitate a home sale". Not my sale ... my case came later. --198.168.xx.xxx

You may consider what other extremely pro tenant areas do such as CA and NY. Go month to month only. S8 doesn't do month to month.

"We have come to the difficult decision that we are unable to do annual leases, but instead we will only be doing M2M going forward" (at her next renewal)

"I will NOT put a family in the street to facilitate a home sale" YEP just like CA and NY. That's why people are paying them extortion fees to get out (cash for keys)
