I had a couple of people pointing fingers at each other in one of my rooming houses, so I showed up unannounced one day and invited each one to pee in a cup to prove their innocence.
Three complied and passed. One agreed to, then couldn't because she'd "just gone," then when I came back a few hours later told me she'd been thinking about it and didn't like how she was being treated and her room was too small and she was planning to move out anyway. Awesome. (She declined to take the test.)
It got me to thinking, though--there are a lot of drug users who never make it into the legal system. Would this be a useful screening tool for prospective tenants? Any civil rights violations? Any legalities that I should be aware of?

I find it pretty incredible that you were able to get any of them to comply with that. I am guessing that the other tenants really wanted her gone pretty bad.
That said, you did an amazing job.
How did you present it to them to get that kind of cooperation?

I don't know that I would ask an existing tenant in a SFH to take a drug test. But what about as a screening tool? Employeers do it all the time as a condition of employment. If the rooming house is a good deal for them, there is a he said she said going on that could get them kicked out and they are clean, that was a simple way to prove innocence and keep their housing. If it’s not in the lease, I’d add it. I don’t know the legalities of it but instead of drug testing for an entrance into the rooming house, you can always share the story of you got the drug using problem tenant to leave. I completely agree that section 8 should require it.
Actually, I think section 8 needs to disappear.
As far as employers requiring it, employers are not physically doing it themselves but rather sending people to a medical facility to have it done.
If a landlord wanted to have this as part of their screening process it would be best to require them to go to a medical facility to have this done. If you attempt to do this yourself, it is likely to end up in court with a judge pointing out that you are not a medical person licensed to practice medicine. Also, it could be said that you did something to taint the sample. Others may sue for discrimination. And it would be extremely difficult to get this implemented as being excepted practice in the first place. If you didn't do it yourself and required them to go to a medical facility, this would be expensive. Just lots of problems. However, it would be a good thing if it could be done. I got a 5-pack off of Amazon for $24. Yes, there's the potential for false positives and false negatives. In fact, one of the tests I administered DID register a positive--but it was triggered by a medication the tenant was on.

I’m guessing you don’t have much experience with addicts. It would’ve taken nothing for your female tenant to call her clean urine source and get a condom full that she’d keep warm in her underwear for when you come back later to retest. I think it’s best for a landlord to not play in this sandbox unless they’re running a sober house for freshly clean addicts coming out of rehab. NE, I'm getting more experience with addicts by the day. I did google "ways to cheat on drug tests" before starting. That's why I showed up unannounced. I could see doing it as part of the two-minute home visit.

I cannot imagine ever getting that intrusive into tenants or potential tenant's lives. I understand the general thought behind it but not the reality, nor the legalities.
What kind of drug test? Who cares if someone had a gummy or two on a Friday or Saturday night? So what if they smoke a joint sometimes? Heaven forbid they have back pain and use some THC cream. A meth addict, surely none of us wants them. Heroin addict, probably the same. But recreational drug use? Especially since it's statewide legal in many, many places. Robin, you seem to treat a positive drug test as proof that the tenant used drugs on/in your property. That is not correct. The tenant could have smoked pot days ago at a friend's place.

Am I the only one that finds "here, pee in this" an awkward conversation to have? Plus there are many false positives like sesame seeds, meds, etc. And what if certain drugs are legal in your state?
Now, one way to accomplish similar is do a litmus swab test on every room in your house while the tenant is there, when they first get screened. Tell them if the swab shows signs of whatever tested for in house, they get fined. But all of this would be awkward in court. And a big invasion of privacy.
Adopt a service animal or emotional support dog that is really a retired drug sniffing dog from law enforcement and bring him along to your screening. That's the sneakiest way I can think of doing it. Everyone else has ESAs, why not let us use that ploy. --108.69.xxx.xxx |
