I read the article and no where in it did it explicitly protect smoking marijuana. It seemed like you can evict for possessing medical marijuana. When NH legalized medical marijuana we discussed it at a landlord meeting and the consensus was you could still enforce no smoking and anyone with a medical marijuana card/prescription could ingest through multiple other ways (tincture, gummies, etc). Many people obtaining marijuana for medical reasons prefer other choices over smoking. --73.149.xx.xxx |

Still Learning, again slippery slope. Further into the article, it drops the term "medical" and just says "MJ use in accordance with state law." Which means recreational. Tobacco is legal as well which means in theory you can't discriminate against tobacco smoking.
It just happens that tobacco is the boogie man as it tends to promote alertness and in some studies, increases testosterone, whilst MJ makes the user passive and unmotivated (perfect for govt that wants a bunch of sheep as subjects).
Most people who use MJ do so in the smoking form and not benign methods such as gummies, etc.
Oti, I have C class area rentals with B class units looking for B class tenants who don't smoke anything. Hoping to gentrify.
MJ smoke is awful and smells like skunk. Probably 10 times as difficult to get rid of the smell. --64.246.xxx.xx |

Can I prohibit tenants from using cannabis?
As a landlord, you cannot refuse to rent to a tenant who consumes cannabis, but landlords, property owners, and rental companies can ban the smoking or vaporizing or growing of cannabis on their premises.
Tenants registered with the NYS Medical Cannabis Program have the right to consume medical cannabis in their home, including but not limited to smoking or vaping whole cannabis flower, cannabis concentrate, and/or ground plant products.
As a landlord, you can only prohibit the use of medical cannabis if it would put you at risk of losing a federal benefit. --73.149.xx.xxx |

Don't deny based on MJ.
Rather, do the 2-minute in home inspection, and when you smell stinky house, deny for house smelling bad. Don't specify why you think the house smells bad. It's not your job to determine the cause; all you need do is recognize the effect. Housekeeping standards are perfectly legal criteria, as far as I know. "Stinky house" is not a protected class.
There are ways to do this... *grins

There are strong talks about removing the MJ line from the Form 4473. People are pushing hard to have MJ's class dropped as well.
As long as the Feds say no I will use that as my reasoning. My state does not allow it, but I think all the states around me do. I have family that make trips to MI monthly to restock.
I think it smells horrible. I admit I am tired of stopping to get fuel for my truck and having to wonder if I would fail a drug test because of second hand smoke coming from the car next to me.
If it becomes federally legal I might try gummies or some such for my aches and pains, not to get high. --107.147.xx.xx |

Because it is a LOT easier to buy pot than medical edibles. And cheaper too I think although I haven't purchased pot in years - but I do know gummies are expensive.
If you are using cannabis for pain and nausea relief you can take a few hits off the same joint several times a day and keep the effects going all day.
Or you can take a gummy, which will take much longer to take effect, and you might have to take more than one a day to sustain the effects.
Plus they are still illegal in many states so not readily available. Of course pot is illegal in those states too but you can still find it. --72.82.xx.xx |

Well to each their own. Not using it doesn't make you a saint. It's a choice.
Cannabis has long been known to provide nausea relief for cancer patients without the side effects of the meds they prescribe for same. It also helps with the lack of appetite which renders many cancer patients emaciated.
It helps with sleep without the side effects of Ambien.
It helps with the horrific joint pain caused by the necessary AI meds prescribed to keep some cancers from returning.
As a medicine, it's a pretty benign one.
It's less destructive by far than alcohol too.
