I have a house with 3 roommates. Two are on the lease.

HOW can I get rid of #3? I originally agreed she could move, but she did not comply before moving in.

Last year I informed that only one rent payment will be accepted and the primary roommate took over paying rent & taking care of the house.

3 months ago, a tenant who had lived there with one current roommate and the former leaseholder asked to move back in. They needed a few weeks to get $ together, completed an application (did not pay the fee) and I sent an amendment to all roommates stating that they all had to sign to allow her to be added to the lease, and told her she needed to pay deposit to me, rent to her roommate, and sign the lease amendment (acknowledging receipt of the lease)

Next thing I know, she has moved in and payed #1 first month's rent.

No deposit, not on lease, many excuses. She got a PUPPY w/out asking (doing damage), is smoking in the house, is behind on rent (I am getting paid, reoommate is not), Still no deposit no permission, trashing the house, etc. --73.106.xxx.xxx

good news is, their lease ends this month. I told them over a month ago that I was extending till 12/31/2024 and then we are writing a new lease.

Tenants 1 & 2 want to stay. Trouble tenant needs to go.

I'm posting for #3 to get out and emailing them all the reminder that the lease ends and is not renewing.

A new lease comes with new rules.

I just want to put #3 on notice NOW that she must go - sooner is better.

I just feel terrible for the dog.

thanks always for great advice and GROUNDING. I ususally have heard the answers here and know, but Bad Tenant played me and #1 against each other. She knew we were preparing to add her to the lease, she gave him first month's rent and told him she was ready to move in. He let her without verifying the lease status with me. It was past 7 days when I found out.

I do NOT rent by the room. THEY agreed to have her as #3, but assumed the paperwork was done and fees paid. --73.106.xxx.xxx

Does your lease call the place a rooming house? If so you can target a single person. If your lease is what the loin's share are - for an entire SFH, then you have to empty it all out.

Evict. Now. All three of them broke your lease and have no interest in complying. They do not respect you or the lease. It will only get worse. Get them out now. None of them are good tenants.

Last night, I did just that - informed all three that lease ends 12/31 and is not being renewed

then I told #1 tenant - who has been great, other than constant complaints to me about his roommates - that I will not be involved in roommate drama.

Their roommate does not understand what it means to be a tenant on a lease and is in violation of numerous rules. therefore no renewal.

I have been feeling partially responsible b/c I approved the roommmate and issued an amendment to add her - which was NEVER signed or finalized. SHE TOLD HIM that i had said all was ok and approved the dog. He did not think to ask me.

The tone changed immediately. He sent 10 texts verifying that he will get things in order and be in charge, not involve me any more, make sure rules are obeyed, etc.

HE does not want to leave, in fact, he wants to buy the house, we want to sell it to him (2026)

He now knows that he can have a new lease in 2025 with full responsibilty shared between tenants.

This is the best rental house we have with highest ROI. He's been a great tenant. We both got played by #3, so she has to go and he is taking responsibility for it.

You do understand, refusing to NOT to renewal is not an eviction.

What I don't understand you saying that "He is a great Tenant" If they are breaking the lease- they are not great tenants. You can only hope that they are trainable tenants. Mistakes are going to happen, so I will take a trainable tenant hands down. --24.101.xxx.xxx
