I’ve got a 2-BR cottage in New Orleans. Two people who initially looked like great applicants want to stay there during Mardi Gras. They both have excellent credit (scores in the 700s), good LL refs, no criminal history, and no record of tenant violations. When my Realtor began verifying employment, one of them stated they were self-employed and did not want to provide W-2s. They want to be listed as an “occupant only” tenant, which is something I’ve never heard of. The other tenant states that they earn enough to be financially responsible for both of them. I told my Realtor I was uncomfortable with this scenario. What if the “occupant only” tenant causes damages and refuses to pay? Since they’d be listed as an “occupant only” tenant, how would I collect on those damages if the other tenant refused on the basis that they didn’t cause them? Besides, the whole thing just sounds fishy to me. What do you think?

Are you doing a short-term rental, a medium-term rental, or a long-term rental?

If it's a short-term rental, just for the Carnival season (Jan 5 to March 4th in 2025), then you can do a fixed-term lease. I do that sometimes with people who are in town for a certain period of time, like interns, but they have a permanent residence elsewhere.

Once, I had some Cuban refugee grandparents. Until their employment-approval documentation came in, I rented to their citizen adult children who lived in the town next door, with the understanding the grandparents were the adult children's guests. After the paperwork caught up with them, they became the tenants directly.

However, if the issue is that they're making you uncomfortable, figure out how to decline them, without getting into illegal discrimination territory. (ie, if you had a married couple, and one was a stay-at-home, you wouldn't penalize them for being a single income family, and the service dog is treated like medical equipment, presuming its documentation was legitimate.)

But a lot really hinges on whether you're doing a vacation/seasonal rental or you're looking for a permanent tenant. A lot also hinges on the socioeconomic status of your tenant pool, and the desirability of your rental--- if you're talking Treme or the 7th Ward, vs if you're talking Lower Garden District. --137.118.xx.xxx

They're reticent to supply W2s either because they are cheating on their taxes or just want to be very private. Maybe you can get the tax returns if you allow them to redact certain pieces of data?

If they are stubborn, I'd pass...no way I'd allow that...as you said they won't be responsible for any damage.

One other option would be to allow them so long as they provide an up-front deposit of $x,xxx that you will make fully refundable so long as your inspection after Mardi Gras turns up no issues...but that inspection would need to be thorough. --64.38.xxx.xxx

They want to stay a month. The property is in a high demand area (Lower Garden District, less than a block off of St. Charles Avenue). It was initially listed on Furnished Finder with just a $1000 deposit (less than half of the monthly rent) which is standard for FF listings. I suppose I could re-negotiate for a larger damage deposit in exchange for the one tenant not providing more detailed income information and being listed as an “occupant only” tenant. Seems like that would give me added financial protection. I’m just wondering why anyone would be so secretive about their income source, and why someone else would be willing to take sole financial responsibility for another person. The fact that it’s kind of a weird situation makes me wonder if the whole thing’s a scam. What would the scam be, though? Am I overthinking it? --174.196.xxx.xx

Awww. When I was a kid in Harvey, we used to visit family friends who lived on the St. Charles streetcar line. We'd run out when the parade was coming by, catch our throws, and run back inside to warm up. It was cold!

Coming back as an adult, my favorite place to stay was the same area, near Terpsichore.

I'm jealous. It's a great location. You're close enough to the parade routes, the French Quarter, but not so close that you can't get away from the crowds and the noise when you're done.

Be confident in your unit, but remember that it's ultimately business.

We can't discriminate against service animals (presuming it has the correct documentation), but do keep in mind fleas and claw damage and shedding and urine if you have hardwood floors or nice rugs. We can't charge deposits for service animals--- so make sure that your cleaning fees and damage deposits are priced accordingly so that if you do end up renting to a (legit) service animal (or just your regular Mardi Gras party crowd), you're comfortable with how the numbers look.

Have you inquired as to what task the dog performs? I know you have a realtor running your information for you--- but it's nice to have a conversation with your prospects so you get a feel for their body language, their communication skills, their situation. Since you've outsourced it, between the realtor and Furnished Finder, are there any other prospects who might be stronger, that you'd prefer?

If you're not comfortable rejecting them outright, you might look at adjusting your minimum stay, or you might look at blocking out a series of dates that are in the middle of their preferred dates. --137.118.xx.xxx
