I have a non smoking building. Newer tenant is complaining about pot smoke smell. It is not any of the other tenants. It is the neighbors. Their property is about 8 feet from mine ( inner city) and I can’t do anything about them smoking on their own property. It is legal here. My tenant is pretty insistent that it is one particular tenant , no proof of course. Now they are complaining about noise from same tenant they say is smoking the pot. Alleged stoner, door slamming tenant has been there a few years with no problems at all. One of my children lives in this multi-family and says that complaining tenant is the noise problem . Apparently her child screams and stomps non stop. My other half says to ignore and don’t respond to whiner. I think that is bad management . I don’t intend to cater to her, but ignoring anything doesn’t make it go away. I don’t want her and her antics to scare away good tenant. It’s a MTM, so she is aware of happy clause. I have a SFH coming vacant soon but don’t know if I should mention it. She is someone who would be better in that but I don’t know that I want to keep her.

I would suggest she move to the country. "City life" doesn't agree with her. Early Lease Termination fee is $XXXX, due in full before move out, along with last month's rent, and tell her no... she can't use the deposit toward her buyout. That's for damages AFTER the lease is terminated.
Otherwise, she need to learn to be content and happy where she is until her lease is over. Get some potpourri.

Yours is a common problem. So I looked up this topic in the UCLA Law Library. I found out that if ONLY 1 TENANT is complaining about an issue, then THEY have to contact and deal with the offending neighbor. But if TWO (2) of your tenants complain about the same problem, then YOU as the OWNER/LANDLORD must step in and try to help.

I would send EVERYONE a reminder letter/. "There have been numerous complaints about noise, doors slamming, stomping, loud music, etc. If this continues the offender will be ejected."
Tell the complainer to record it on their phone.
"Not sure" -when in doubt, don't. If not sure about keeping this person, don't.

Wow she sounds like PITA tenant that I jettisoned a couple yrs ago. "Ms. Excuses" middle aged woman who complained about everything. She was actually THE PROBLEM.
Send noise letter including your policy (police report, etc), then Happy clause/30 day notice.

Thank you for all the replies. This is why I love this site. So many views to give me a fresh perspective on it. I do tend to overthink things . I did smile at the thought of waiting for them to discuss the problem with the offending party =the neighbor. This is the hood, that is how melees happen.
