Hi guys,
I was sued from a tenant who tripped and felled couple years ago. My insurance found a lawyer to represent me. Today I received good news that they (tenant's lawyer and insurance's lawyer) had settled and the case was dismissed. That really made my day :-D The insurance lawyer only sent me a court order of dismissal (one page paper). Since this is my case and I am directly involved, I would like to know the settlement terms/agreement. Does the insurance have to share this info when the client (me) request? Should I ask for something else that now the case was dismissed? Please share your thoughts/experiences. Thanks.

I don’t know why but many times the insurance company will not share that information even with their insured. I once said a slip and fall on a walkway. There was nothing wrong with the walkway, and the insurance company settled with my tenant. I could never find out the settlement terms, but my agent did say I would be happy. Jim[CA], Why did your agent said you would be happy? Or did you mistype and it supposed to be your tenant would be happy (from a large settlement)?
WMH[NC], In Chicago there are two levels of lawsuit: under $50K and over $50K. My case was filed in the over $50K category. This tenant is low income (Section8). I'm 100% sure that she got free medical treatments and never spent a dime. She's also a retired grandma. Hence, no lost of income. All she was trying to get is pain and suffering money.

I put in a written request to my insurance carrier, trying to ascertain what settlement my insurance decided to make, to avoid a costly trial. They refused to share any details with me.
They made an offer which was accepted by the "victim/tenant/fraudster". My insurance rate almost doubled. So I went to my tenants married son, living in another state and offered him $1,000 to give me a copy of his parents file. I learned that once my insurance settled with them, a claim was made by "others" and my carrier made a double payment to avoid trial and my maximum coverage.
My carrier by mistake disclosed I had an umbrella policy with them, after I instructed the carrier I refuse to allow them to disclose my excess coverage, held in an LLC so no one could cross reference.
So I then sent my insurance a demand letter for return of my extra premium. After receipt of my letter they cancelled my umbrella and general policy. It went to arbitration and they lied to the mediator/judge.. Had they disclose things to me, I had proof my tenants were not serious injured. They were playing of the high school sports team and won the championship.
I got my extra payments back and my premium was put back to the original amount

My insurance company settled for $150k with a neighbor.
There was no lawsuit. The insurance company wanted to settle before it got to that point. The insurance company said we would loose in a jury trail - even though we were not at fault.
The lawyer got 1/3 of the settlement.

I would think in a result of settlement, the insurance company would NEVER want to amounts disclosed, lest others see the insurance company as a target for more lawsuits. I was kinda under the impression that settlements were never to be disclosed. No experience with it, just my perception.

plenty[MO], the court case and all events are in online court case. However I couldn't find (or don't know) whether the settlement agreement is also available online. Chances are it might not.
Robert J[CA], wow what a story. So, in California the insurance doesn't have to disclose the settlement agreement with the insured?
MMIT[VA], you wrote "My insurance premiums went up". That's scary. Did it go up a bit (10%-30%) or a lot (2X or more)? Did you have to formally requset your insurance company to the settlement agreement? Or they just told you over the phone/email?
Busy[WI], I believe some settlements are public knowledge while some are private. The personal injury lawyers usually know how much this type of case could get them. So, it doesn't matter whether the insurance disclose this. The lawyers already know. That's my perception. --185.172.xx.x |

Great news - Yes you can ask for it. But it is doubtful that the insurance company will share such trade secrets........but that doesn't mean you can't still find out.
If this was indeed a settlement the court records will state that the case was settled but not the terms.
If however you ask the agent if you should change companies directly after that settlement (which would indeed be foolish), the agent will probably tell you no (as they should), but that would then open up the door for you asking for the CLUE Report. BAM - the amount settled upon will show up there. Just straight out asking for the CLUE report after a settlement would probably get you at best a scrubbed report - but if you gave them bait to give you the entire report....you are considering changing companies, then you should get that info. --24.101.xxx.xxx |
