Did they complain of mold but won't leave - So you need an attorney to deal with them?

Does IL not allow you to non-renew a lease without "cause"? That would be a pretty good reason, anyway. So, why the need for an attorney? --72.218.xx.xxx

Initial test showed slightly elevated level of Chaetomin due to a small pipe leak that went on some time undetected. Went through a month long remediation, took out all visible mold and cleaned the air. However the clearance test showed that the result was even worse than before the remediation: it shows no visible mold but air borne mold spore level was much higher than that before the remediation.

Now, as I am preparing for the 2nd round of remediation, the technician who went there for the estimate said that the kitch floor which was previously sealed is now completely wet! ( I wasn't there for the estimate) and suggested that the floor needs to be taken out.

the property is in Chicago and I am living in NC. The tenant is currently staying with her parents who live nearby, but have the access to the property the whole time during the remediation. Not only that, She was actually staying overnight in the property the night before the clearance test just to "test if she can sleep well". I had to fly over to Chicago every weekend the past monththings to make sure that thing are going smoothly and taking pictures for documentations etc.

So what should I do next? if things are continuing to run unchanged I feel that this remediation would never ends. I did offer to buy her out 3X but she refused --73.93.xx.xxx

Don't give her the option. Time to end the lease. Give her 30 day notice and return her security deposit in full. After 30 days change the locks. Fix and re rent for more $. Read your lease and follow your state laws --172.59.xxx.xxx

Ok. Glad you moved on it quickly, as we did as well. Make sure you have your offer to buy her out OR "happy clause" in writing.

The tenant gave us a 26 page report from a mold inspector and we followed some of the recommendations from his report. The first thing I did was buy an "air scrubber" which clears the air of spores. I bought one used in hospitals during COVID and at the Ronald McDonald house here continually. They are not cheap. I bought two. One for the apartment and one for the basement just below her apartment. The smell went away within a few days. Before remediation, we had to have the areas treated, they had to be dried out. The remediators did that for us, tested for moisture, then remediated when it tested dry. I took pictures of the test results...read everything I could about the type of mold she had problems with. I'll post back with the name of the "air scrubber". It is also referred to as an air purifier, but it is more than that.

The air scrubber would eliminate the air spores. The scrubber I purchased --75.11.xx.xx

Ok. The name of the air scrubber is Vollara Aire and Surface Pro. I used to see them sold on Amazon but just checked and did not find them. They are mobile, easily carried.

Check out you tube videos for more info and how to service them yourself. Also google Vollera Air Surface Pro and go to their website and purchase from them or they will recommend a dealer in your area. They should be cleaned every 3 months.

If you have trouble finding a dealer, I can forward the name of mine. I know he is based in Waukesha and is also a LL. I know he travels to Madison and other areas so IL may not be out of the question. If you buy one, have the mold remediator test after using the Vollera. Maybe that's all you need. Hang in there!

Document and date what you have done in the event you need it. I have not needed it yet, but have saved everything. --75.11.xx.xx

@MO thank you for your advise. Since she moved in on May 31, which to this date is less than 4 mo, I think a 30 day nonice would do the job in Il given the length of her stay and the lease term.

Does anyone have any recommendation for attorneys in Chicago I'd much appreciated. Or, any eviction attorneys would be able to handle this just fine? just in case the whole thing turns ugly down the road... --73.93.xx.xxx

You're ending the agreement due to the house not being habitat. It's not an eviction or length of time left of lease. It's that you truly don't have a property to rent out. R ad your lease agreement and follow what it reads to end. A law degree is not necessary. It's not an eviction. All relationships end. --172.59.xxx.xx
