Any good way to prove you sent money? I have a crazy lady that is vengeful because we are evicted her. We sent the security deposit a while ago but she hasn't cashed the check or responded to why she hasn't. With all the nasty things she has pulled in the past, I wouldn't be surprised that she is going to claim we never sent it.This is Ma and big penalties and judges that believe anything a tenant says over a LL.

I'm thinking about sending her a notice that we are stopping the check,.and Issuing another but how to get it to her? With a certified letter, she could say it was an envelope filled with a few coupons or something else and not the check.

Yes, she has done things just as crazy in the past.

Maybe a process server but again she could say it wasn't a check..

Any ideas?

Probably a long shot, but you have her number and her email? Look her up on Zelle - attempt to send her a dollar to see if she is registered on there.

Here, like plenty said, we are only required to SEND it - USPS 3817 Proof of Mailing.

We use ShippingEasy.com $3.46 which provides us proof of mailing AND tracking to show delivery. We can do that from our office without a trip to the Post Office. We can require signature by adult for a fee.

DO NOT play games to try to help her. If you cancel the check YOU will be in violation. A free atty would eat your lunch.

Didn't trust the tenant; recently sent one back via UPS tracking for proof. They send a picture when it is delivered. I take a picture of what is being put in the envelope and tracking number is shown on the receipt.

Okay, again she made sure to pay each month tried to get her out for violations other than nonpayment and she really wanted to say. She also the unit clean. So what am I worried about? As I said she is truly crazy, entitled, and vengeful. You would not believe all the problems we had with some of the crazy things she did.

She told another tenant that she wasn't going to cash the check we sent her.( Perhaps the claim she never got it and was due three times the security deposit that can be done in Massachusetts?) she is not hurting for money, so she can wait for those funds.

So some are missing the point that I'm trying to make. Yes I can send her things registered or certified but how can I prove it was exactly what it was for, the return of the security deposit. She could claim there was either nothing in the envelope or some type of notice.

has anyone in their lifetime absolutely positive that they sent a check in a business or a utility and it was claimed that they never got it? Is happened to be several times in my life but there is no problem as that business just once their money and you can send them another check.

This case I'm pretty sure she wants to use it as a tool somehow. If she cashed the check I can prove that she got it but if she claims she never got it how can I prove that she really did. All I can prove is something was sent to her. By the way I did make a mistake of just sending it regular mail as I did not think there would be any problem like this. But again I'm not sure that would mean anything anyway.

I wish there was some way I could send it directly to her bank, an agency, the court or whatever in her name, but I don't think any of those are possible.

IF, because we are being presumptuous here (are you thinking this into existence?), that she does claim that she never received it, put the burden of proof on her to prove that she told you that she never received it.

At this point with what you have done so far, you send her an email or text, however you normally communicate with her, that says Hey, you haven't cashed the refund check that we mail on *date*. Please let me know if that arrived safely. If not, we can arrange for a duplicate check to be sent to you. The accounting for the deposit was included with the original refund check, but let me know if you need another copy of that accounting.

OK, that would prove I sent SOMETHING, but it doesn't say that I sent her the sec deposit,.She has been able to stay in this unit for almost 2 years as she has been to court and claimed incredible crazy lies about harassment's that never happened and some of them were emails and notices that we never sent and the judge did not ask her to produce them! That we were calling her and then hanging up on her at all hours.

We are pretty sure she vandalized other tenants cars ,on and on,.She WAS a good tenant for a while but seem to suddenly deteriorate..I think she might be on drugs (her daughter living with her has been arrested twice for drugs,) I think she is capable of doing just about anything.

Getting funds to her even by a process server wouldn't work

Maybe hiring an off duty police officer that would COUNT cash in front of her with audio of saying what its for,..and have someone film it? Its about the only thing I can think of. Thats if this savy,crazy and evil woman would let him in her new dwelling.

Don't create a problem that doesn't exist yet.

You are probably right but the word is "reasonable".

The only other eviction I ever did was in front of the same judge, this tenant owed us a lot of money, also caused big problems with our other tenants but cried tears in court that she had problems finding a new place,.his ruling was that he gave her possession of the unit, but we would have to file for a new eviction for the back rent.(delaying months more and expensive lawyer fees and of course she didn't pay an additional 6 months.)

Thank you RentsDue,..so,.. would you now send a new check with that and cancel the other one with a note saying somethng like "it seems that check may have been lost as our back has no record of it being summited. so we cancelled that check and have issued this new one, please cash it as soon as possible"

and maybe photo everything. and maybe even print them out including a copy of those photos in that package to show that we are serious of documenting it?

So would you do the priority mail thing with a fancy, glitzy envelope now? Maybe a note also included that "it seems like the check we sent you may be lost as our bank has not reported that it has been cashed. So we are canceling that one and issuing this new one. Please cash it as soon as possible."

And maybe photograph the letter, and the check proving that we are serious about documenting all. Maybe even saying that we are copying our attorney or someone else.

One more thing if you would, where the heck do you find fancy, glitzy, envelopes? I don't think I've ever seen one.
