I own a duplex and my son is my handyman for the property. The other day, he shows me a video of one of my tenants in the middle of a compromising act. This occurred outside the unit and was not taken by anyone involved with a building I own. I'm not going to go into detail as to what the tenant was doing, suffice it to say, it is disgusting and embarrassing on tenant's part but I don't think it's something I could reasonably evict for however. I am not sure what, if anything to do with this information. My son has suggested using this as leverage to increase their rent, keep security deposit, etc. Could something like that possibly get us into trouble? What would you do if you came across a compromising video of one of your tenants? --128.92.xx.x |

Do you absolutely beyond a doubt know this wasn't even AI generated by someone who doesn't like the person?
If the answer is no, you are not an expert and you haven't been yourself been spying on this tenant 24/7 - then I believe the court will rule any video as hear say.

ARGH I hate when people ask about "keeping" the Security Deposit.
YOU CAN'T JUST KEEP A SECURITY DEPOSIT!! That is not how it works.
If, when the Tenant has someday vacated, you find damage caused by them that is not normal wear & tear, you can apply the deposit towards the cost of repairing the damage.
If they leave without proper notice, you can apply the deposit toward any financial damage you might suffer as a result.

You play that card. Then what?
Do they curl up into a fearful ball and promise to pay your higher rent? Promise too forfeit their deposit? Or do they get angry and escalate far beyond anything you want to mess with, to punish you for threatening them?
Suppose they escalate. Do you tell police/fire/ambulance/the judge, "They did this after I tried to blackmail them?"
Write a script out with all the endings. I could probably come up with a dozen scenarios without trying hard. None of them are worth getting that ball rolling.

I'm curious if by "compromising" you mean it would just be embarrassing if people saw it (i.e. got drunk and got naked at a bar or something) or you mean they were committing an illegal act.
I mean, I assume you just mean embarrassing since that is what you said -- but the fact that you then go on about not being able to evict for it and wanting to increase rent or keep a security deposit is just on a whole different (crazy) level.
They don't seem connected to me. I've seen my tenants do stupid things in their private lives over the years and NEVER was my first though "I wonder if I can raise their rent or keep their security deposit for this."
As others have said... If this is a personal issue, ignore it. If this is a legal issue, report it.

If you truly can't look at this person or do business with them anymore and you are POSITIVE your info is correct, terminate the lease as soon as you can. I know my Ts did some gross things but it didn't affect my business with them. I thought they were trashy and stupid though. We all have lines.
