I really would like to get rid of a tenant that has some basic violations of her rental contract,..(Ie: smoking and has a cat) But this is Ma.

She got section 8 after moving in and a mainance man saw in a unused bedroom a number of cigarretts butts and smoke smell) BUT MAINLY she is a very nasty old lady that if she has an issue of any type,.she never calls us but the BOH,..like a ceiling fan making noise, a dripping facet, etc. and the BOH in this tiny town writes us up like its a hovel and a dangerous thing giving us a very short time to fix it, Many complaints by her,.noise coming fro the neighboors across the street,..doesn't like how the snow is removed etc.

So we have put up with her for 5 years but its getting worse,..i think there is some dementia going on,.

Anyway is it true we have to give her 3 or 4 months notice? I believe she will try to fight it with a free lawyer.

Is it better to say we want her out for cause of those violations, or just ask that we want the unit back without giving her a reason to fight it.?

Here is Los Angeles, West Hollywood and Santa Monica, Section 8 is a Cash Cow for their respective City's. Why? Each month when the City cuts a check to pay the rent, the money they receive from the State to Support my Section 8 tenant is 25% larger then they outlay--it's called making a profit.

So when my Section 8 tenant violated their lease, the City came to their defense and told the Judge I was the liar. So before the next hearing, I paid other tenants in the building to "Trap" this tenants cat. A 2 year old male cat that was never fixed and pee's in and out of their apartment several times a day. So I took the cat with me to the Housing Hearing. I asked the Judge did he mind if I give the cat some water. With no objections, I opened up my cat carrier and set out a bowl of water. The cat was on a leash. My tenants said they did not have a cat. After drinking a large bowl of water, the cat began to steak out his territory. He pee's on the floors, chairs and portioned walls. The judge instructed the court bailiff, to take the cat out of his court room, around back and shoot it. The tenants little girl said, "Your not going to kill my cat".

Just raise the rent more than housing is willing to pay. Lease will expire. They will stop auto deposit on your rent. Then file for eviction due to non payment.

Easy peasy.

Tyran, just before I saw your post,.I posted a similar one asking the same,.. thank you,..but I did raise the rent about 4 months ago, can I raise it again? Is there a limit to how soon or how much?

But she would probably use any thing she could to fight removal, can't I just want the unit back w/o giving a reason?

Increases can only be submitted with lease renewal. 60 days prior to lease expiration in writing.

No limit on what you ask for. Just price in your "pain" and expect a rejection. Then the real fun begins. --198.168.xx.xxx
