We have a husband and wife/tenants living in our log cabin next door to us. they are senior citizens. they pay the rent on time each month, which we know is a big plus. they have called us several times over this past year with clogged pipes. they throw food down the kitchen sink, never vacuum, dust or clean the bathroom. My husband I have gone in several times to clean out the pipes and clean the dishwasher filter which is always clogged with food and grime and find the place really dirty.
we have inspected it while in there and there's no visual damage but the bathroom is taking a toll from the grime, water on the floor from the shower and filthy walls
they told us the cabin is small and and doesn't need to be cleaned!!! I recommended to them a cleaning lady but they refuse to pay for one.
Could this be a reason to evict?? should we let them stay and keep their deposit to fix any damage? they are very difficult people to deal with. need advise on what other landlords would do. thanks --54.242.xx.xx |

I wouldn't call it an eviction but I would read our written lease agreement and give them notice to Cure or Quit. And a date to reinspect the cabin for the correction of the violations. That's what I would do. And they are not taking care of the property and yes I would end the agreement at the first point of exit. It will require all these requests and ending lease to be in writing on paper. I would say what plenty stated is a good idea. Give them a WRITTEN demand to cure or quit (maybe 5 days or whatever you feel is the appropriate timeframe - not a month tho). On the letter state when you will be there to inspect (if they don't quit).
Are they on a lease or month to month? How long have they been there? That is going to make a difference in how you can move them out.
If they don't do anything (cleaning) then I would provide proper written notice (30 day, 60 day, 90 day) and have it served to them the way it needs to be (we have a Marshal here that does it for us). If you don't or don't know what to do then maybe see an attorney but they usually don't like to get involved and the ones that do... will charge you quite a bit I think. They also don't always give the best advice so make sure you ask around some before you just take what they say for the right thing to do.
Anyhow, that's what I would do. If they are in a lease then you most likely are going to be better off waiting for the lease date to come to an end and not renew. Hopefully it isn't too long since you are in NY and the powers that be are looking to change the laws once again.

You're in NY so I'd suggest a different tack. Give them X day notice (whatever your state requires) that their lease will not be renewed at the end of their term. I would not state a reason just give the notice. If they ask, You can state you are going in a different direction with the rental if you want to state a reason. The real reason is you want them out so you can clean and find decent clean people. Be prepared to evict if you have to. I'd also suggest that you call a plumber for clogged pipes and add/bill that to their rent charges. I am sure your lease states the tenant is responsible for all clogged drains unless the plumber determines it is from natural causes. I am not a plumber and neither is my husband. A clogged toilet, unless it is caused by a failure of the plumbing system, is the tenant's fault and responsibility.
What does your LEASE say about condition of the property during tenancy? What does your LEASE say about plumbing? What does your LEASE say about...anything?

First I'd get rid of the garbage disposal and tell them to use the regular trash instead. Hopefully your municipality hasn't opted into the "Good Cause Eviction" laws so that you actually CAN non-renew.
Be advised though that you can expect to have 3 to 4X the length of vacancy if you screen then you did in the past, which you should do very carefully since in NYS, you're stuck if you get a bad egg. --64.246.xxx.xx |

Realize not everyone is a good renter, and YOUR job is to find and place people who can pay on time AND care for your property.

Good renters pay the rent in full and on time, keep the place clean and in good order, are cooperative, and are good neighbors.
Your tenants fail on all counts except the first. Thus, they are not good tenants. They are marginally bad tenants.
I've had places that were so filthy roaches infested it. Cost over $4000 to clean and repaint. Carpets were destroyed. Furnace circuit board shorted out. Lost 1.5 months of rent while doing the turnover.
"Paid the rent" is not a magic phrase that somehow gets rid of thousands of dollars lost to filth, damage, and vacancy. Send 'em packing as soon as the lease expires. --184.4.xx.xx |

Eileen, so how many years have they been your tenants? Easiest choice is to end tenancy w proper notice. Second option is to inform them that all service calls will be at their expense unless it is determined that your infrastructure is at fault. 3rd, if you need to serve papers look for a process server. Cheaper than a lawyer and they know the rules. For the tub, might an enclosed shower door or splash guards and magnet curtain fasteners help? In the end it sounds like they gotta go from what you say. Can you afford to not have them there, and are you worried a winter vacancy? --172.59.xxx.xx |
