Had a turnover where Tenant damages add up to over 6k after applying all Ts security deposit. He said he doesn't have the money to pay it. I know he has funds but he's just choosing not to pay it. Everything was done correctly as far as condition checklists on move-in/out, pictures, videos etc so I have all that and a record of him saying he's not paying.
What would be the best way to go after this money without spending a lot myself to get it?

The best way - is to prevent the damage from occurring. Routine inspections and a serious check sheet outlining what is expected along with corresponding initial and follow up training.

In Texas, I can't garnish, so it's in my best interests to spot problems before they accumulate. Once I see a problem, it's on me to say, "I need to get rid of this person before they damage the house even more---" rather than "Well, the house is damaged, at least they're paying every month, I'll deal with it when they leave."

You will occasional get someone who is good that turns bad on you. They are tough to catch as the yare going bad as a landlord. I don't want to get involved in the tenants personal life.
There are a couple of research questions for you to find out: What is the max amount that you are able ask for at the lowest level court.

What are the damages? As long as a judge would say wear and tear and cut that 6k number down to $500, I would take them to court without a lawyer if possible. All you have to lose is filing fees and some of your time. --73.159.xxx.xx |

The bulk of the damage came in an oversized two car garage. Over the last month he lived there he decided it make it into a commercial kitchen. Full sized grill and grease covered everything including heating system, water heater etc. Stove top smashed and all new appliances with significant dents. Things like that make up the 6k
Question, in taking to court. Would you do it yourself or hire someone. Just trying to decide if this is going to be worth my time. I don't want to let him get off with nothing at the same time. --24.151.xx.xxx |

I don’t know MA laws but that should be easy to look up. When we bought our first building, an outgoing tenant didn’t pay last month’s rent and ruined the dishwasher. Previous own had incorrectly let tenants use security deposits as last month rent for his ownership. Tenant owed me $1500 and I filed in small claims for a fee of less than $100, figuring it was a good learning experience for me. We were offered mediation and agreed. I had my evidence and kept quiet. Tenant argued and was obnoxious. Mediator finally asked, did you live there? He said yes. She said you owe rent. I agreed to let dishwasher amount go. She wrote it up with a claw back clause saying if he didn’t pay in full or on time I could go after the full amount. He paid monthly which was $50-100 (can’t remember) and got all the way to owing $100 and didn’t pay. I filed a paper stating he didn’t pay in full and a bench warrant was issued. Nothing ever came from that but I got most of the money. --73.159.xxx.xx |

In MA you can collect up to $7,000.00 in small claims court either in the district court or the local housing court & the filing fee is about $150.00. Just to chime in about my area:
This would be small claims court as we max out at 10k plus court costs. I am an LLC and I have to use a lawyer. If over 10k I can move to a different court. I recently found this out when I had damages from an old tenant for over 10k, unfortunately I had already filed in small claims.
I do not have the eviction or damages problems like I used to. I have learned thru wallet training.
Make sure that your lease states they are responsible for your attorney and collections fees unless not allowed in your state.
I go after them no matter what now. Just to remind them about what they did. Been trying to get a long lost deadbeat to pay up. He refuses. They did a lot of damage, in my case $4600. I started the filing process last week. Reminds me I need to see what is going on with that. --107.147.xx.xx |
