Just listened into a webinar sponsored by "LawNY."
They started out with the premise "fact" that the legal/justice system in NYS is systemically biased against minorities and thus all these new laws and procedures. They spouted statistics which of course can be misconstrued in any fashion.
Thus, they urged even private landlords that they could be in trouble with the law for:
1. requiring an income to rent ratio
2. googling a person's name before the application process to see if they had any run ins with the law
3. denying on the basis of low or no credit score
4. denying on the basis of a previous landlord reference
6. denying on the basis of a criminal background check or pending criminal case
7. denying on the basis of evictions or pending eviction.
This is particularly true IF you participate in any state/government housing program and the fact that "Clean Slate" is coming to NY in November of this year. They had two extremely elaborate worksheets for determining acceptance as a tenant...which, by the sound of it is that if you don't rent to anyone who can fog up a mirror, then you are being "discriminatory."
They encourage ANY tenant applicant whether subsidized or not to approach their office with a discrimination claim as regards the above seven bullet points.
I did stump the presenter for a second (who ended each sentence in an inflection) by asking "Doesn't HUD require people to pay no more than 30% of their gross income in rent and utilities?" And she immediately pivoted to the case of the tenant with no income that is completely subsidized, and you have to rent to such a person no holds barred.

Webinar designed to strike fear into NY Landlords, mission accomplished. Spewing bull, they are wanting to push the envelope even further by using the court system to expand tenants rights. Who is funding these crazy lawyers?
At some point you have to consider investing in a state that will allow you to be successful in running your business, NY clearly doesn't want that to happen. Most of the judges in TX would laugh each and everyone of those 7 out of their courtroom. --209.205.xxx.xx |

#1 is the only item that might affect a ll. The others are law or common sense. Don't look someone up and automatically dq them if they are a criminal. How bad is the crime and how long ago. Don't think it's illegal to refuse drug dealers and wife beaters. Look them up to see if they smoke. I don't ever deny for credit score, just sometimes for the story it tells or the lies it reveals. #4 it's rare to find a ll who will say anything. I'm more likely to not move forward if the ll does not return my call. #6 same as #1, if you reject everyone with a criminal history you might have an issue. And #7 is state law. Still more tenants are organizing and speaking up for each other. Just yesterday one said a ll has to pay for the heat and hw not the tenant. NY says the ll must provide heat and hw. While she worked her BF smoked pot and partied with his friends while watching the kids.
She was a great gal to talk to, but he got the best of her.

The thing that you have to watch out for with tenants from south of the border, they have a culture that says they must take care of their family members. So, if they have a house rented, and relatives enter the country and need a place to stay, they just move in. You can end up with a lot of people in your rental that you were not expecting. I haven't noticed that they are any cleaner or any messier than anyone else. People vary in their level of cleanliness and it doesn't have much to do with ethnicity.
A big problem in Southern California is the subletting of hot rack space to a ton of undocumented persons and apparently, it is difficult to get them out. So that is something to be aware of. --76.178.xxx.xxx |
