Wanted to give an update on my decision as to how to address the garage situation with the gravel floor and nails, and also the storage that might occur in the crawlspace and attic.

I also want to thank everyone for your suggestions.

I want to thank Jason[VA], for the lease clause example.

Here is a copy, not sure how it will paste on here, of what I plan to use as an addendum to my lease, at least until I get a better reading and idea of Brad's lease. ;

Attics, Basements, Garages, Crawl Spaces, and Sheds Addendum To Fixed Lease

ATTICS, BASEMENTS, GARAGES, CRAWL SPACES, AND SHEDS IN THE EVENT THE DWELLING HAS AN ATTIC, BASEMENT, GARAGE, OR SHED, USE OF THESE AREAS ARE NOT INCLUDED IN THE RENT, NOR SHALL IT BE CONSIDERED LIVING SPACE. ANY USE OF THE ATTIC, BASEMENT, GARAGE, OR SHED SHALL BE AT TENANT'S OWN RISK AND LANDLORD SHALL NOT BE RESPONSIBLE FOR ANY DAMAGE TO TENANT’S ITEMS STORED IN THESE AREAS. TENANTS AGREE TO BE RESPONSIBLE FOR MAINTAINING THESE AREAS PROPERLY, INCLUDING USING A DEHUMIDIFIER IN THE BASEMENT TO MINIMIZE MOISTURE. TENANTS AGREE THAT THESE AREAS ARE NOT TO BE USED FOR PET SHELTER(S), REFUSE STORAGE, FIREWOOD STORAGE, OR ANY OTHER USE THAT MAY CAUSE A STRUCTURAL OR SANITARY CONCERN. CRAWL SPACE SHALL NOT BE USED AS STORAGE OF ANY KIND. TENANTS HEREBY GRANT LANDLORD THE RIGHT TO PERIODICALLY INSPECT THESE AREAS.

Happy to help but now that I see it written, I think there’s one minor correction needed:

CRAWL SPACE SHALL NOT BE USED AS STORAGE OF ANY KIND.

I believe should be changed to “shall not be used FOR storage”. --174.106.xxx.xxx

In one section you say they use the areas at their own risk, and in another section it says the space shall not be used for storage of any kind.

Could be a bit confusing.

Why not just say none of the areas may be used by tenant for anything, and lock them up? --68.229.xxx.xxx

I see a minor conflict when you say that you're not responsible for any damage caused in these areas, but yet the tenant is STILL RESPONSIBLE for maintaining them? So is that to say that if a tenant NEVER even went into the basement or used it that they'd be responsible for a problem down there upon move-out?

I would say something like "If tenant chooses, at their own risk, to use any such areas, they are also responsible for maintaining such area such that upon move-out it is in as-good or better condition as upon move-in". --64.38.xxx.xxx

Thank you to everyone once again for your assistance and advise and thank you to Jeffrey for providing a place for us all to learn from one another.

I have rewritten my addendum after looking over the replies from the other post and the email Plenty sent.

Addendum :

Attics, Basements, Garages, Crawlspaces, and Sheds Addendum To Fixed Lease

In the event that the dwelling has an attic, basement, crawlspace, sheds, and/or any other “extra spaces”, the management and/or owner(s) shall not be held liable for any damages caused to tenant(s)/resident(s) and/or their guest personal property or their persons, for any such use of these areas.

These areas are not intended for use as living quarters, nor should they be used as such.

There are no warranties or guarantees of any kind for any damages and or theft that may occur to tenant(s)/resident(s) and/or their guest vehicles for use of the garage(s) and/or shed(s), as some garages and/or sheds may leak, sweat, and/or have gravel floors and could have nails, screws, metal objects, and the like that could cause punctures to tires. Some garages and/or sheds do not have locking doors, or any doors at all. However, care has been taken to “sweep” the floors with magnets to try and eliminate any such occurrence. As with any such space, these are used at tenant(s)/resident(s) and/or their guest own risk.

There shall be no storing of anything, of any kind, by the tenant(s)/resident(s) and/or their guest in the attic(s), crawlspace(s) and/or other “extra spaces (such as utility closets)” without written approval by management and/or owner(s), as such areas are for maintenance use.

Maybe as an added last sentence;

These areas are considered as part of the property and any damages done to these structures by the tenant(s)/resident(s) and/or their guest, shall be considered as damage to the rental property and shall be treated as such.
