Tenant complained of leaking. Likely occurred because tenant changed a bathroom vanity 3 months ago and caused leaking in the wall. Repairs to plumbing and floor around $5k and will take 5 days. Should tenant pay for all or some of the repairs? Also only one bathroom in the house with 9 tenants and it will be out of service during repairs. Not having a bathroom is a habitability issue, I'm not sure a judge would agree that 5 days is a reasonable time to have this repaired especially on the left coast. Most handymen could have this knocked out in a couple of days tops. I would discuss it with the tenant and see if they can crash with friends or family for a couple of days and discount the rent a bit.
If you are sure they caused the damage then they are responsible for repair (and the cost of alternate housing during the repair). That said, if you go to court, how are you going to prove that? Do you have coorabaration from your plumber that the line was incorrectly installed or caused a failure in the pipe? You will probably need him as an expert witness so get his statement written down. --209.205.xxx.xx |

I do NOT allow tenants to change things like that. Period.
IF I find they did it without permission:
1. They would KNOW I was ticked off.
2. I’d inspect the work as soon as I knew about it, just to check for things like leaks, or shoddy workmanship, or poor supplies.
If they changed it because what was there was junk and a reasonable landlord would have replaced it long ago, then I think you need to own up and fix the place up. If they changed it because they didn’t like the style, I’d give notice to vacate.
I really cannot think how three months of leaks can leak to $5000 in damages. Oh, wait, you are in CA. You probably have to have an environmental evaluation and remediation just for a kid splashing water out of a tub. In Milwaukee, this ‘d be done in a couple of days, and for much much less. Cali? sell. You let 9 people in a house with one bathroom? Tenant did work without your permission? If tenant did it with your permission, you didn't inspect the job afterward to make sure the tenant did it right? just sell.
If you knew about the vanity and didn't inspect, the $5k bill is all yours. If the tenant did it on their own, evict. 3 months of water damage shouldn't cause $5k in damages. --73.2.xx.xx |

I am slow and lazy but I could keep a single bathroom operational during a rehab if need be.
If it is all on you then talk to the person doing the work and see if a schedule can be thought out.
If it is on the tenant and you are sure the courts would see it that way then bill them up front for the work and have them stay elsewhere during the project.
That is a lot of people for one bathroom. Might look into more commercial grade type fixtures as well if you plan on having that many people stay. --107.147.xx.xx |

9 people is a lot of wear and tear to begin with. Hope you are getting max rent. I wouldn't offer a motel-my guess is you would be paying for 3 rooms for X days-probably more than a months rent. IF it was deemed caused by them, I would replace the toilet and shower as quick as possible. I do question the 3 months ago repair showing up now. Is it just behind the vanity? If so, they can deal with the bathroom torn apart. It is still usable except to wash hands. --73.230.xxx.xx |
