Tenant was given a lease renewal page to sign with the rent offered for 12 more months, a month before lease was up. There was a slight increase to cover taxes and insurance but still a very good rent rate.

However no answer since. They had indicated they had thought about moving a couple months ago due to some kid in the neighborhood messing with their car. The kid was caught... but they decided its a 'bad neighborhood' and they want an apartment with security cameras. OK why not... we'll look at putting them in, I said. I'm always one for permanent solutions.

I also just put a motion light in by their car. So I couldn't be doing more to address concerns.

What do other people do in this situation? Understand they need time to think but we need some advance notice of vacany and left to their own devices they probably will just spend the month apartment shopping.

I feel like once they get the flight itch nothing not even reason will stop them from abandoning the next and leaving the usual pile of garbage in their wake..... but I've already got one vacancy and really don't want two at once.

My lease auto-renews with an automatic rent increase of 2.9%. They have to give written notice to me of NOT renewing, or we agreed already that is what happens.

Modify your lease accordingly, and for this batch send them a notice of non-renewal. If they want to stay, they JUMP on the phone and call you. Then you can take it back... IF they sign and return your form.

The key to managing tenants is this:

1) Give clear information.

2) Specify what happens if they respond.

3) Specify what happens if they do not respond.

4) Follow through.

This kind of automating of your business will save your sanity and make you more money.

P.S. If I ever want MORE than 2.9%, I also have the option not to renew the current lease, same as the tenant does... but I can offer to sign a brand new lease at a higher rate. There is literally zero downside to this method in terms of managing rental renewals.

If they don't sign and the lease ends and they haven't left, then they are a holdover. What does your lease say about holdovers? Mine says that the lease continues on a month-to-month basis with a 25% increase in the monthly rent. (Which I bet is more than you are offering them for the renewal.)

No renewal received then advise them that their lease is terminated effective in 30 days or What your state requires. My lease goes from one year to month-to-month after the first year. Since you're in Illinois like me, you know that the best time to get new tenants is now. If we wait longer, it would be much harder to fill the vacancy when it gets cold. So, don't let tenants hold the apartment without renewing the lease for long. You'll have a hard time rent it out if they leave by end of Fall. most jurisdictions have very specific holdover guidelines for holdovers w/o landlords permission.

most provide for 200 percent of the last previous rental rate

This is a common, everyday problem in LLing which most LLs CREATE themselves.

Easily solved with a proper lease so you never have this problem again.

My lease is clear: This lease automatically renews for another full 12 months on it's anniversary date each year, with an automatic 2.9% or more Cost of Living increase.

Sounds like your tenant is in charge, not you. Tenants break leases like a dog breaks wind. What does your rental agreement state about extra fees for breaking the lease? I don't do leases - month to month for me. That way, I'm not giving someone a year long committment to low rent. If they move in a friend or a dog or don't take care of the lawn or any of a hundred other things, I can raise the rent - you can't unless you've spelled it all out in your lease agreement. If I want them to move, I can raise the rent to the current standard move-in rate. This way, if I have to put up with all the BS you leasers do, at least I can get paid for it, or put a stop to it. --73.2.xx.xx

Weren't you talking about the drastic property tax increases you got hit with?

I know you don't want an empty unit, but you are close to bleeding money as it is. Now this tenant is playing games with you?

Your family deserves better than this. Give them the option to sign now or your lease is expired and they can leave.

Scares you to think about the empty place, but once you get it filled with a good tenant it makes up for it.

When a tenant chooses to not renew a lease, they are telling you they are leaving. Send a letter stating a non-renewal requires a higher monthly payment of an additional $350.00. This is because they are now on a month to month rental agreement.

The "why" is because they have already been talking about moving. If they are not going to renew the lease they need to get out now, so Duplexer doesn't end up with them moving out in October and leaving him with a winter vacancy.

Out now so he has a chance to fill the apartment while it is still summer.

Send them a notice that since they did not renew the lease, they are to get out by *date* and that overstay rent will be $XXX per week. --76.178.xxx.xxx
