On my latest rehab i hired a tree guy to trim some trees owned by the neighbor with his knowledge and permission hanging over my property.The tree guy i hired got the neighbors permission to pull into his driveway to do the job, when he pulled into the driveway suppodsely he damaged the driveway.The tree guy agreed to take care of it but never did.I received a letter from an attorney asking both me and the tree guy for insurance info and threatening to sue, bid to repair it is $3400.I am not giving him my insurance info, if i loose i will write him a check then sue the tree guy.I do not feel i should be held responsible for this, i didnt tell my tree guy that he could use the neighbors driveway, him using the driveway was between the tree guy and the neighbor not to mention tree guy said he would take care of it.I realize everyone gets sued.What do you guys think? --74.77.xx.xx |

6x6 No I did not,in all my years of doing this i have never been threatened to be sued due to what a contractor or employee did.
RB- I have no problem with the neighbor, he is just a dumb old man doing what his attorney tells him to do, most people dont think very hard,they just do what there attorney tells them to do
GKARL- I think he has insurance and he will hand it over at the first appearance in court is my guess.If it gets to court the judge will tell me i have to have an attorney and wont allow me to talk to the judge but i will be able to talk to the neighbors attorney.I am thinking of sending him a letter but probably should remain quiet --74.77.xx.xx |

Your state probably has a contractors state licensing board with a website that has a lookup function. You can usually use the guys first and last name or name of their business or phone number and find out if they're licensed and who their insurer is. --73.2.xx.xx |

I was threatened with a lawsuit one time.
Tenant fell in a water meter pit that was left open. Lawyer contacted me, the water company and the meter reading company.
They wanted my insurance info. My agent said don't do it and I didn't.
That was the last I heard from them. They tried to sue the water company who said it was the meter reader company's fault. They dragged it out for a pretty long time and settled on some tiny amount that I am sure the lawyer got the most of.
I would let it slide until (if) you get summoned. Maybe talk to the neighbor and let him know it is all on the tree guy. Then again it might be better to not talk at all.

The neighbors tree comes down on the neighbors property and you are expected to pay for the damage because you wanted the tree down. Who owns the tree? Where did the tree drop at, your property or his? I think you need to show those holes in lawn from his tree chunks hitting the ground hard. In college i learned that you NEVER want to drive a truck onto a driveway or paved area because most are just a couple of inches of asphalt over some gravel and are not designed to support the extra weight. If you have to, or the customer wants you to, have the owner sign a form that you are not responsible for damages. I wanted lowes to drive a spider up my driveway w sheet rock but they would not. Ken that is a reminder that i have a hugh tree job coming up and the arborist needs to access the property behind me on the other street. I will be sure to ask for a certificate naming me as additional insured. Never hurts to get a 2nd quote for the work, especially if you have a company you have a relationship with. --172.59.xxx.xxx |

Neighbor gave tree guy permission to do the thing that led to the damage. It's between those two. I wouldn't say or do another thing until (and if) I get a court summons.

Exactly what Sid said... it's not on you at all. The tree guy should have known better.
I had one taken down and the neighbor told the guy the same thing (he needed to use a crane). The tree guy said "nope... but thanks" and for that same reason. He knew it was going to ruin his driveway.
He ended up going in from the back of the property from a different neighbor... they knew each other and laid planks down (or whatever) but still fixed his lawn where it needed to be done because he still knew that it was going to damage some of it. --67.253.xxx.xxx |

I was sued once. Lawyers would try to sue everyone hoping to get something from someone. It's possible that his lawyer would sue you with or without your insurance info. That's what they did to me. The lawyer sued me for my tenant felt in the apartment. So I had to contact my insurance to send their lawyer to help defend me in the lawsuit. --99.128.xxx.xxx |
