I made it to 75! Yay me! I think another poster from years ago shares the same day, Aldo?
We have 21 rentals and have been doing this since the 80's. Our last eviction was 3 years ago, we were lucky during Covid but did have 7 turnovers that same year ('21), it was ragged! Used it to up rents and it's ok.
Fast forward to today, all I want is to get deadbeat out at present time, court Friday, wish us luck. I feel we are as prepared as we can be. Just hope we get judgment without any delays, with a 10 day for appeal anyway, it will still throw us into July. I waited to ask about rent until the 10th on a 3 year tenant (breakup). This shows how even a few days delay can really set you back, as we have 14 day pay or quit in VA now, not 5. Yuck. --216.126.xx.xxx |

I believe it's been switched back to a 5-day notice. Make sure you are reading the 2024 version - Check it out:
§ 55.1-1245. (Effective until the later of July 1, 2028 or seven years after the COVID-19 pandemic state of emergency expires) Noncompliance with rental agreement; monetary penalty
F. If rent is unpaid when due, and the tenant fails to pay rent within five days after written notice is served on him notifying the tenant of his nonpayment, and of the landlord's intention to terminate the rental agreement if the rent is not paid within the five-day period, the landlord may terminate the rental agreement and proceed to obtain possession of the premises as provided in § 55.1-1251. If a check for rent is delivered to the landlord drawn on an account with insufficient funds, or if an electronic funds transfer has been rejected because of insufficient funds or a stop-payment order has been placed in bad faith by the authorizing party, and the tenant fails to pay rent within five days after written notice is served on him notifying the tenant of his nonpayment and of the landlord's intention to terminate the rental agreement if the rent is not paid by cash, cashier's check, certified check, or a completed electronic funds transfer within the five-day period, the landlord may terminate the rental agreement and proceed to obtain possession of the premises as provided in § 55.1-1251. Nothing shall be construed to prevent a landlord from seeking an award of costs or attorney fees under § 8.01-27.1 or civil recovery under § 8.01-27.2, as a part of other damages requested on the unlawful detainer filed pursuant to § 8.01-126, provided that the landlord has given notice in accordance with § 55.1-1202, which notice may be included in the five-day termination notice provided in accordance with this section. --68.229.xxx.xxx |

WmH, in Va if they don't pay by the 5th, on the 6th we can give a pay or quit notice, Va can't seem to make up her mind but right now it is 5 day pay or quit. So I guess I am right in saying on the 11th day of the month you can go file an unlawful detainer (76.00), it is about a 2-3 week wait for court date. --216.126.xx.xxx |
