State Specific Question About: CALIFORNIA (CA)
I need to move into my condo quickly so must terminate a month to month tenancy with my current tenant. Facts about this particular tenant: she is late paying rent every month (so far I counted 21 times!) is this ground to terminate a month to month tenancy?
Or should I terminate tenancy as owner that needs to move in? In that case do I have to give 60 days as she lived in condo for over 1 year? Do I have to pay for her moving costs?
And finally, can I combine both reasons: 1) she is always late with rent payment + 2) I am owner who intend to move in to end tenancy ? --98.159.xx.xxx |

60 day notice is required. Unless you’re under rent control I don’t see any need for a relocation allowance. Be sure you follow the laws and offer an inspection two weeks prior to move out to identify all items which you believe to be damage, not normal wear and tear. This is critical.

I kind of am a newbie...obviously...and I am kind, I know I should have not allowed it and possibly my tenant took advantage of my kindness...
You live you learn, right? I am in need of some help on how to right the wrong and also, I really need to move into my condo myself.
Jim, thank you for your advice, I understand 60 days notice, what about reason? What it's easier: owner intent to move in or ending tenancy due to constant late payments? Can I use the fact tenant has made so many late payments as reason to end tenancy?= in California?

As noted above, you get what you allow and a judge could likely say that because you allowed it so many times, YOU set the precedent, Tenant now expects to be able to pay late and without a stern written notice discontinuing the practice and some multiple days or months (it's CA) notice, you can't evict because of it.

I agree with others - you let late payments happen so that ship has sailed. You need her out because you need to move in. Late payments this many times is not a legit reason. Don't even mention it or you'll cause more problems for yourself.

Give 60 days notice (because tenant has been there more than 1 year) and offer tenant a chance to have a moveout inspection with you two weeks before end of rental agreement so they can correct potential problems that would ding their security deposit. Perhaps, may I suggest, you read your lease and do what it says about this situation. This is not an eviction, you'd simply like to end the agreement. Is this agreement for a years, is it month to month? I would not give a reason other than you want to end the agreement. Your business isn't any of the tenant's on why you want to end the agreement. The sixty-day notice should include two full months. The earliest that the tenant will leave is September 1st if you send the letter now. If you use email and/or text with the tenant, make sure that you send also send a letter. You just want to confirm that your message was communicated just in case you are called into court.
Please keep a record of all of the late payments by keeping your statements over the past twenty-one months. You can use it as evidence.
